Rules 63 to 68 are the working rules for sections 30 and 31 of the Act. Rule 63 prescribes Form LD-12 for rectification, with a statement and extra copies. Rule 64 gives the proprietor two months for a counter-statement. Rule 65 covers rectification on the forum's own motion. Rule 66 deals with Board orders. Rule 67 requires a prompt request to change a recorded address. Rule 68 covers the proprietor's correction and cancellation applications.

This article reflects the Rules as amended up to G.S.R. 689(E) dated 14 September 2012 (the only amendment). Check sicldr.gov.in for later notifications. Fees are those in Schedule I as notified in 2001; the Registry's forms page lists the same amounts (checked 3 October 2026). Where the Rules mention the Appellate Board, no notification bringing sections 32 to 53 (and 55) into force was found in the India Code record or on the Registry's notifications page (checked 3 October 2026); check the current position before relying on that route. For a contested entry, take legal dispute resolution advice before filing.

Rule 63: applying to rectify

"An application to the Appellate Board or to the Registrar under section 30 or sub-section (1) of section 48 for making, expunging or varying of any entry relating to a layout-design in the register shall be made in duplicate on Form LD-12 accompanied by prescribed fee and shall be accompanied by a statement in duplicate setting out fully the nature of the applicant's interest and the facts upon which he bases his case."

ItemRequirement
Form and feeForm LD-12; Schedule I, entry 10: Rs 2000
CopiesApplication and statement in duplicate
Applicant who is not the registered proprietorApplication and statement left at the Registry in triplicate
Registered usersAs many extra copies as there are registered users
TransmissionThe Registrar sends a copy to the proprietor, each registered user and any other person who appears from the register to have an interest

The statement must set out the nature of the applicant's interest and the facts. The rule names both the Board and the Registrar; the Registrar route under section 30 is in force and the Board route carries the commencement line above. The section is explained in sections 30 and 31.

Rule 64: the proprietor's reply

"Within two months from the receipt by a registered proprietor of the copy of the application mentioned in rule 63, he shall send to the Registrar on Form LD-3 a counter statement in triplicate of the grounds on which the application is contested and if he does so the Registrar shall serve a copy of the counter-statement on the person making the application. The provisions of the rules 35 to 41 shall thereafter apply mutatis mutandis to the further proceedings on the application."

That brings the evidence and hearing rules in Rules 33 to 38 and Rules 39 to 43 into rectification. Schedule I, entry 3: Rs 500 for a counter-statement under section 30. The forum "shall not, however, rectify the register merely because the registered proprietor has not filed a counter-statement", and "in any case of doubt, any party may apply to the Appellate Board or the Registrar, as the case may be, for the directions." So silence by the proprietor does not decide the matter.

Rule 65: rectification on the forum's own motion

Section 30(3) lets the forum act on its own motion after notice. Rule 65 prescribes that notice.

  1. 65(1). It is in writing to the registered proprietor, each registered user and any other person who appears from the register to have an interest. It states the grounds on which rectification is proposed and "shall also specify the time, not being less than one month from the date of such notice, within which an application for a hearing shall be made."
  2. 65(2). Unless a person notified sends a written statement of the facts relied on to meet the grounds or applies for a hearing within that time, he "may be treated as not desiring to take part in the proceedings".
  3. 65(3). If the forum decides to rectify, it communicates the decision in writing to the registered proprietor and each registered user.

Rule 66: Board orders to the Registrar

"Any order of the Appellate Board to the Registrar for rectification of the register shall indicate the details of making, expunging or varying an entry in the register. The Registrar upon receipt of the notice in Form OLD-7 from the Appellate Board shall rectify the register accordingly." This matches section 30(4). It is described with the Board commencement line above; Form OLD-7 is among the official forms in Schedule III.

Rule 67: change of address

67(1) and (2): forthwith

A registered proprietor or registered user whose principal place of business in India, or home-country address, changes so that the register is wrong "shall forthwith request the Registrar on Form LD-18"; where the address for service in India changes, the request is on Form LD-19. The Registrar alters the register if satisfied. Schedule I: entry 16 (Form LD-18) and entry 17 (Form LD-19), each Rs 1000, "unless exempted from fee under rule 67(3)".

67(3): public-authority changes

Where a public authority alters the address so that the new address designates the same premises, the request may be made on LD-18 or LD-19 with the authority's certificate, and the Registrar "shall not require any fees to be paid on the form, notwithstanding the provisions of sub-rule (2) of rule 10 or sub-rule (2) of rule 11." This is the only fee exemption in the Rules covered here.

67(4) to (6): copies and signing

A proprietor making a request serves a copy on any registered users and informs the Registrar; a registered user serves the proprietor and other users. A person whose address for service is the address of several proprietors or users may, on proof, apply on an amended Form LD-19 for alteration of all those entries. Applications on Form LD-19 are signed by the proprietor or user, or an agent expressly authorised, unless the Registrar allows otherwise in exceptional circumstances.

Rule 68: the proprietor's correction and cancellation applications

Where the registered proprietor applies under section 31(1) "for the alteration of the register by correction or change of any entry relating to layout-design or cancellation of entry of layout-design", the Registrar may require affidavit evidence of the circumstances. The application is on "Form LD-6, LD-17, LD-18, LD-19 or LD-20 accompanied by prescribed fee as may be appropriate", and a copy is served on registered users and any person who appears from the register to have an interest.

FormPurpose (Schedule I)Entry and fee
LD-6Correction of error or amendment6: Rs 300
LD-17Change of name or description with no change in proprietorship or identity15: Rs 1000
LD-18Alter address entry16: Rs 1000
LD-19Entry of an address for service in India17: Rs 1000
LD-20Cancel the entry of a layout-design (section 31(1)(c))18: Rs 1500

A registered user's own application is covered in Rules 59 to 62. The address rules also tie to the address-for-service rules in Rules 16 to 20. Forms LD-17 to LD-20 may go to the head office or the appropriate office under rule 7(2)(b).

A worked example

A competitor believes an entry for a start-up's layout-design was made without sufficient cause. It applies on Form LD-12 in triplicate to the Registrar, with the Rs 2000 fee and a statement of its interest, and the Registrar transmits copies to the start-up and its registered user. The start-up sends a counter-statement on Form LD-3 within two months. Meanwhile, the start-up changes its address for service and requests the alteration on Form LD-19 forthwith, serving a copy on its registered user.
