Patent Government Fees in India

On e-filing, a patent application in Form 1 costs ₹1,600 for a natural person, start-up, small entity or educational institution and ₹8,000 for any other applicant. The request for examination in Form 18 costs ₹4,000 and ₹20,000. Renewal starts at ₹800 and ₹4,000 a year for the 3rd to 6th year and rises to ₹8,000 and ₹40,000 a year for the 16th to 20th year.

Table I has four fee columns. The first and third are for a natural person, start-up, small entity or educational institution. The second and fourth are for others, alone or with a natural person, start-up, small entity or educational institution.

The fee in entry 1 is multiplied in case of every multiple priority. An application or specification for a patent of addition under section 54 gets a reduction of 50 per cent in fee as compared to other applications.

Renewal and Restoration

The renewal fee under section 53 is paid before the expiration of the year that comes before the year being renewed. Entry 18 has no form number.

Under rule 80(3), as substituted by the Patents (Amendment) Rules, 2024, renewal fees for two or more years may be paid in advance, and a ten per cent reduction applies where the renewal fee is paid in advance through electronic mode for a period of at least 4 years.

Late Fee and Penalty

Renewal fee not paid

The patent ceases to have effect if the renewal fee is not paid within the prescribed or extended period. Rule 80(1A) allows up to six months more on Form 4 with the entry 4(i) fee for each month; after that, restoration under section 60 must be asked for within eighteen months of the date the patent ceased. No request for examination

An application is not examined without Form 18 or 18A. If the request is not made within thirty-one months from the priority or filing date, whichever is earlier, the application is treated as withdrawn. Patents Act s.11B(1), 11B(4) · rule 24B(1)

Working statement not filed

Failing to furnish the statement of working (Form 27) attracts a penalty of up to ₹1 lakh, plus ₹1,000 for every day the failure continues after the first. A false statement attracts up to one half per cent of turnover or gross receipts, or ₹5 crore, whichever is less. Patents Act s.122 · as amended from 1 Aug 2024

False claim of a patent

Marking an article "patent" or "patent pending" when it is not patented or applied for in India attracts a penalty of up to ₹10 lakh, plus ₹1,000 for every day the claim continues after the first. Patents Act s.120 · as amended from 1 Aug 2024

How to Apply and Pay

How to Use This Chart

  • Find your column first. A natural person, start-up, small entity or educational institution pays the lower scale. A joint application that includes any other applicant pays the scale for others.
  • Count sheets and claims before filing. Entry 1 adds a fee for each sheet beyond 30 and each claim beyond 10.
  • Opposition (entry 9), expedited examination (entries 29 and 30) and sequence listing pages can be paid only on e-filing.
  • Add the request for examination to the filing cost. An application is not examined without Form 18 or Form 18A.
  • For renewal, check the year being renewed, not the year of payment: the fee for the 3rd year is paid before the 2nd year ends.

Under entry 1 of Table I, Form 1 costs ₹1,600 on e-filing for a natural person, start-up, small entity or educational institution and ₹8,000 for others. On physical filing it is ₹1,750 and ₹8,800. Each sheet beyond 30 costs ₹160 or ₹800 and each claim beyond 10 costs ₹320 or ₹1,600 on e-filing.

A request for examination in Form 18 under section 11B and rule 24(1) costs ₹4,000 on e-filing for a natural person, start-up, small entity or educational institution and ₹20,000 for others (entry 28(i)). On physical filing it is ₹4,400 and ₹22,000.
