11-month term vs registered lease

An 11-month Leave & License is the most common format because a lease of 12 months or more triggers compulsory registration under the Registration Act, 1908. Keeping it to 11 months (renewable) avoids that in most states.

Stamp duty & registration

Stamp duty is a state tax paid on the agreement value (rent + deposit); rates vary by state. Registration (at the Sub-Registrar) is mandatory for terms of 12 months+ in many states, and for Leave & License in states such as Maharashtra regardless of term.

Notarised agreement

A notarised agreement is signed before a Notary Public, who attests the signatures. Notarisation adds credibility but is not a substitute for registration where registration is legally required.

01Why are rent agreements usually for 11 months?

Because a lease of twelve months or more must be registered under the Registration Act, which adds stamp duty and registration cost. An eleven-month leave and licence arrangement avoids compulsory registration while still being enforceable.

02Is a rent agreement valid without registration?

A leave and licence agreement under eleven months is generally enforceable if properly stamped. Several states, notably Maharashtra, nonetheless require registration of leave and licence agreements irrespective of the term.

03What stamp duty applies?

It is a state levy, usually computed on the rent and deposit for the term. The agreement must be executed on stamp paper of the correct value, or e-stamped where the state provides for it.
