® RenewedWhat is Trademark Renewal?
A registered trademark in India is valid for 10 years from the date of filing the original application — not the date the ® certificate was received. After 10 years, the trademark must be renewed by filing Form TM-R with the Trademark Registry and paying the prescribed government fee. If renewed on time, the trademark can be kept alive indefinitely — there is no maximum number of renewals under the Trade Marks Act, 1999.
Renewal is entirely administrative — unlike objections, oppositions, or hearings, there are no substantive disputes to resolve. The Registry simply needs the form, the fee, and confirmation that the proprietor wishes to continue. However, the consequences of missing the renewal window can be severe — from paying a surcharge during the grace period to full removal from the register if the grace period also lapses.
Validity runs from the application date — not the certificate date
Many trademark owners assume the 10-year clock starts when they received their ® certificate. It does not — validity runs from the date of application filing. Since examination, objections, opposition periods, and certificate issuance often take 12–24 months, the certificate may arrive with only 8–9 years of remaining validity. Three Renewal Windows — Which One Are You In?

Up to 12 Months Before Expiry
You can file Form TM-R as early as 12 months before the trademark's expiry date — paying only the standard government fee. This is the recommended window: no surcharge, no risk, no complexity.

Up to 6 Months After Expiry
If you miss the renewal before expiry, the Trade Marks Act provides a 6-month grace period after expiry during which renewal can still be filed — but with an additional surcharge on top of the standard fee.
Government fee: Standard fee + surcharge (Rule 63 of the Trade Marks Rules)
Risk level: Low-Medium — trademark may appear as "expired" on the register during this period, which competitors can see. Act quickly.
6 Months to 1 Year After Removal
If neither the standard renewal nor the grace period renewal is filed, the Registry formally removes the trademark from the register. After removal, restoration can be applied for within 1 year from the date of removal — but this is more complex, costlier, and not guaranteed.
Government fee: Standard fee + restoration charges
Risk level: High — trademark is removed, protection lapses, competitors may apply for the same mark, restoration can be rejected.
