How to Use This Chart
- Count the classes first. Entries 1, 2, 3, 4, 5 and 17 are charged for each class.
- Pick the applicant group before reading entry 1 or 17: individual, start-up and small enterprise pay half of what other applicants pay.
- E-filing is 10 per cent lower than physical filing in every entry that allows both.
- Entries 12, 17, 18 and 23 can be paid only on e-filing. The Schedule shows physical filing as not allowed.
- Entries 4, 5 and 21 are add-on fees. Add the fee of the entry they refer to.
- Government fee only. Professional charges, search charges and stamp duty on a power of attorney or an assignment deed are not in the Schedule.
- The chart follows the First Schedule as printed in the Trade Marks Rules, 2017. No rules amending that Schedule are among the saved official texts, so a later change, if any, is not reflected.
- Fees payable to the International Bureau for an international application under the Madrid Protocol are not in the First Schedule. Entry 23 is only the handling fee of the Indian Registry.
- The conditions for being treated as a start-up or a small enterprise are in the definitions in the rules and are not reproduced here.
