Design Registration Government Fees in India

An application to register a design in Form 1 costs ₹1,000 for a natural person, start-up or small entity and ₹4,000 for any other applicant. Extension of copyright in the design under section 11(2) in Form 3 costs ₹2,000 and ₹8,000. A petition to cancel a registered design in Form 8 costs ₹1,500 and ₹6,000.

Late Fee and Penalty

Copyright not extended in time

Copyright in a registered design lasts ten years from registration and can be extended once for five years. If the extension fee is not paid the design ceases to have effect; it can be restored only on an application within one year, with the restoration fee, the unpaid extension fee and the additional fee. Designs Act s.11, 12, 13 · rule 25

Objections not cleared

The applicant has three months from the statement of objections to remove them or ask for a hearing, and the application must be completed within six months from filing, or within three more months asked for on Form 18. Otherwise it is deemed withdrawn or abandoned. Designs Rules 2001 · rules 18 and 21 (as amended 2008)

Piracy of a registered design

A person who copies a registered design for sale is liable for every contravention to pay the proprietor up to ₹25,000, recoverable as a contract debt, with a total of not more than ₹50,000 for any one design; or the proprietor may sue for damages and an injunction in a court not below the District Judge. Designs Act s.22

Articles not marked

If articles sold are not marked as registered, the proprietor cannot recover a penalty or damages for infringement unless he shows he took all proper steps to mark them or the infringer had notice of the copyright. Designs Act s.15(1)(b)

How to Apply and Pay

Yes, in effect. Rule 11(3) says that to register the same design in more than one class of article, a separate application shall be made in each class, and each application carries the entry 1 fee.

Rule 2(ea), inserted in 2014, covers an enterprise whose investment in plant and machinery, or in equipment for a service enterprise, does not exceed the limit for a medium enterprise under section 7(1) of the MSMED Act, 2006. A small entity files Form 24 with proof, such as evidence of MSMED registration for an Indian entity.

Rule 2(eb), inserted in 2021, covers an entity in India recognised as a startup under the Startup India initiative, and a foreign entity meeting the turnover and incorporation criteria of that initiative that submits a declaration.

Under rule 5(2)(e), as substituted in 2021, where an application of a natural person, start-up or small entity is transferred in full or in part to any other person, the new applicant pays the difference between the two fee scales with the request for transfer.

Three months from the official communication of the objections, to remove them or ask for a hearing, and the period for removing objections cannot go beyond six months from the date of filing (rule 18(1)). Since 2008 it can be extended by up to three months on Form 18 with the entry 19 fee, asked for before the six months end.

Under section 22, for every contravention up to ₹25,000 payable to the registered proprietor as a contract debt, with not more than ₹50,000 in total for any one design. Or the proprietor may sue for damages and an injunction. No such suit can be filed in a court below the District Judge.
