Overview

Ind AS 114, Regulatory Deferral Accounts, notified under the Companies (Indian Accounting Standards) Rules, 2015, is a narrow-scope standard for entities whose prices are set or approved by a rate regulator — typically utilities such as electricity, gas and water. In rate-regulated environments, timing differences between costs incurred and amounts recovered through regulated tariffs can create balances that other Ind AS would not recognise. Ind AS 114 provides an interim accommodation for these balances on first-time adoption.

Scope and Eligibility

Application is limited to a first-time adopter that conducts rate-regulated activities and that, under its previous GAAP, recognised regulatory deferral account balances. Existing Ind AS preparers cannot elect into it. The election is optional; an eligible entity may apply the standard or, if it does not, must remove regulatory balances that fail to qualify under other Ind AS.

Recognition and Measurement

Rather than defining new recognition criteria, Ind AS 114 permits an entity to continue applying its previous GAAP accounting policies for the recognition, measurement, impairment and derecognition of regulatory deferral account balances. Changes to those policies are allowed only if they make the statements more relevant and no less reliable, or more reliable and no less relevant.

Presentation

StatementPresentation requirement
Balance sheetSeparate line items for total debit and total credit regulatory deferral balances
Profit and lossNet movement shown as a separate line, outside ordinary sub-totals

This separate presentation isolates the effect of regulatory deferral from other items so users can see performance both with and without these balances.

Worked Example

An electricity distribution company incurs ₹5,00,00,000 of fuel cost increases that the regulator has agreed to allow recovery of through higher tariffs over the next three years. Under its previous GAAP it recognised a ₹5,00,00,000 regulatory deferral debit balance. On transition to Ind AS, being a first-time adopter with rate-regulated activities, it elects to apply Ind AS 114 and continues to carry this ₹5,00,00,000 balance, presenting it as a separate regulatory deferral line rather than derecognising it.

Impairment and Disclosure

The entity must consider whether regulatory deferral debit balances remain recoverable and adjust for any impairment. Disclosures explain the nature of, and risks associated with, the rate regulation, and the effect of that regulation on the financial statements — including the basis on which balances are recognised, measured and derecognised, and the rate of return or discount used.

Key Point

Ind AS 114 is essentially a transitional relief that avoids forcing rate-regulated first-time adopters to immediately write off regulatory balances they legitimately expect to recover. It preserves comparability with their prior reporting while ring-fencing these amounts through distinct presentation and robust disclosure.
