Variety Denomination explained: this guide covers what it means, who it applies to, the step-by-step process, documents required, fees, due dates and penalties in India — so you can stay compliant with confidence and avoid costly mistakes.
The Use of Denomination Rules, 2012 prescribe the "manner" of use that section 68(1) of the Act leaves to the rules. They say the denomination and registration details must be shown on the container, in a conspicuous, clear and legible place, on the container and on every outer covering; they say when a registered agent or licensee is using the denomination; and they treat applying a denomination in India to a variety for export as use.

Under section 68(1), only the breeder, a registered licensee or a registered agent may use the denomination of a registered variety. These Rules, made as G.S.R. 903(E) of 17 December 2012, require the container of seed of a registered variety to show the denomination and the details of registration (rule 4). The denomination must appear conspicuously, clearly and legibly on each container and on every covering in which it is packed (rule 6). Use means printed or visual representation (rule 3). An agent or licensee's use counts only if the four conditions in rule 7 are met, and applying a denomination in India to a variety to be exported is use (rule 8).
Where the Rules come from
G.S.R. 903(E) of 17 December 2012 was made by the Central Government under section 68(1) of the Act, read with section 96(2)(lxiv), which allows rules on "the manner of using the denomination of a variety under sub-section (1) of section 68". The short title is the Protection of Plant Varieties and Farmers' Rights (Use of Denomination of Registered Variety) Rules, 2012. They came into force on publication in the Official Gazette. The notification is a scanned print and the rule numbers print unevenly; rule 7 appears with an erroneous number and is read as 7 in sequence.
Section 68 prohibits anyone other than the breeder or a registered licensee or agent from using a registered variety's denomination. Section 68(2) deems a person to apply the denomination if they apply it to the variety, to a package in which the variety is sold or exposed for sale, to things placed in a package bearing it, use it in a manner likely to lead to belief that the variety is designated by it, or use it in a commercial document where the variety is delivered against an order by that denomination. See sections 68 and 69.
Seed companies and distributors that label and sell registered varieties can ask our IP watch and enforcement team to review their packaging against these Rules.
Rule-by-rule
| Rule | Provision |
|---|---|
| 2 | Definitions: "Act", and words defined in the Act carry the Act's meaning |
| 3 | "The use of a denomination in relation to a variety registered shall be construed as a reference to the use of printed or other visual representation of the denomination" |
| 4 | "The package or any other container, containing the seeds of a variety registered under the Act shall indicate the denomination and details of registration obtained under the Act" |
| 5 | Use of a denomination in relation to a registered variety means use "upon, or in any physical or in any other relation whatsoever, to such variety" |
| 6(1) | The denomination "shall appear on each container of seed in a conspicuous place on the container in which the seed is packed and on every other covering in which that container is packed and shall be clear and legible" |
| 6(2) | The application of a denomination within the meaning of section 68(2) and (3) of the Act is also construed as use of the denomination |
| 7 | Use by a registered agent or registered licensee is construed as use of the denomination where the four conditions listed below are met |
| 8 | Use is construed as use in India only; applying a denomination in India to a variety to be exported from India constitutes use |
Rule 7: the four conditions for agents and licensees
The use of a denomination by a registered agent or registered licensee is construed as use of the denomination where:
- (a) the agent or licensee is connected in the course of the trade;
- (b) the variety's denomination remains registered for the time being;
- (c) the person is registered as licensee or agent under the Act; and
- (d) the person complies with the conditions and limitations to which their registration is subject.
A distributor that has not registered its title under section 28(4), or one whose licence has ended or is being breached, does not satisfy these conditions. See rules 45 to 49 on registering an agent or licensee.
A labelling checklist
The checklist below is built from rules 4 and 6.
| Check | Source |
|---|---|
| The registered denomination is printed or otherwise visually shown | Rules 3 and 4 |
| The details of registration obtained under the Act are shown on the container | Rule 4 |
| The denomination is on each container in which seed is packed | Rule 6(1) |
| The denomination is also on every other covering in which that container is packed | Rule 6(1) |
| The place is conspicuous | Rule 6(1) |
| The denomination is clear and legible | Rule 6(1) |
| The user is the breeder, or a registered agent or licensee meeting rule 7 | Section 68(1); rule 7 |
| For export, the denomination applied in India is the registered one | Rule 8(2) |
The Rules do not say which details of registration must appear (they leave that to "details of registration obtained under the Act"), do not set a minimum type size, and do not describe a penalty for non-compliance. The Act's offences and penalties in sections 70 to 73 concern false denomination and false claims; see sections 70 to 73.
A trade mark may be associated with the registered denomination only after informing the Registrar in writing and may not be used alone; that is regulation 8(2) of the Regulations, 2006, covered in the denomination regulations article. Together, the two instruments mean that a brand name may appear on the packet, but the registered denomination must also appear in the manner rule 6 requires.
Use in India and for export
Rule 8(1): "Use of a denomination of a variety shall be construed as use in India only." Rule 8(2): "Applying a denomination in India to a variety to be exported from India shall constitute use of the denomination." So a seed exporter that prints the denomination on packets in India for shipment abroad is using the denomination for the purposes of the Act, and must be the breeder, a registered licensee or a registered agent. Use outside India is not use under the Rules.
An invented example: Greenfield Seeds registers a hybrid sunflower under a letter-and-figure denomination. It packs seed in sealed pouches and cartons. Under rule 6(1) the denomination appears on each pouch and on each carton, in a conspicuous place, clearly and legibly, with the registration details required by rule 4. Its licensed distributor, registered under section 28(4), prints the same label; rule 7 makes that use the use of the denomination. An unregistered reseller that prints the denomination on its own packets is not within section 68(1).
Need help with labelling and enforcement?
Packaging that carries a registered denomination is both a compliance duty and a point of attack against copiers. Our IP watch and enforcement team can audit your labels, monitor the market for misuse and prepare action against false denominations.
