Part IV (rules 64 to 68, beedi and cigar premises) and Part V (rules 69 to 83, factories) of Chapter IX of the Gujarat Occupational Safety, Health and Working Conditions Rules, 2025 govern the licence of beedi and cigar premises and the approval of plans, licensing, renewal and appeal for factories. The fee figures are exactly as printed, and the schedule has been checked against the Gazette page.

Later amendments and State notifications under these rules should be checked in the State Gazette.

Amendment, renewal, transfer and closure

  • Amendment (rule 76). Needed on a change of the factory's name, or if the horse power or number of persons exceeds the licence limits; the application reaches the Chief Inspector-cum-Facilitator or the local Inspector within 30 days of the event. No amendment is needed for changes in workers or horse power unless they involve a higher fee. The fee is the difference between the higher fee and what has been paid for the year or part; a late application pays an additional 25 per cent of that fee.
  • Renewal (rule 77). Form 33, sent by registered post with the treasury or digital payment receipt, to reach the authority not later than 60 days before expiry; a factory that commences work on or after 1 November applies on or before 1 January of the following year. Renewal may be applied for for 10 consecutive years, with fees 10 times the Schedule fee. A late application pays an additional 25 percent.
  • Transfer (rule 78). Application before expiry; fee of 10 % of one-year renewal fees.
  • Deemed licensed (rule 79). A factory whose application was duly made, with the form, particulars and fee receipt, is deemed licensed until the licence is granted or renewed or refusal is communicated.
  • Death or insolvency (rule 80). The successor is not penalised during the time reasonably needed to apply for amendment.
  • Suspension and closure (rule 81). If before 31 October an occupier notifies in writing that the premises will not be used for the year following, the licence may be suspended or cancelled; revival is on a renewal application with 25% of the relevant fees. The occupier and manager send information in duplicate to the Inspector-cum-Facilitator before an intended closure, on actual closure and on re-opening, in the particulars the rule lists.
  • Owner of premises (rule 82). Where buildings, floors or rooms are leased to different occupiers, the owner is responsible for common facilities such as approach roads, drainage, water, lighting, sanitation, fire protection, canteens, rest rooms and crèches.
  • Appeal (rule 83). The occupier or manager appeals against an Inspector-cum-Facilitator's order to the Chief Inspector-cum-Facilitator within 7 days of communication, and against the Chief Inspector-cum-Facilitator's order to the State Government within 7 days, each entertained later on sufficient cause.

A worked example

Pandit Alloys Pvt Ltd, Vapi, plans a factory with 80 workers and 120 horse power installed. It first obtains approval of plans, filing Form 31 with the process flow diagram and plans; if nothing is conveyed within 30 days, the plans are deemed approved. For the licence in Form 33 it reads the Schedule: above 100 to 250 horse power, 51 to 100 workers, so Rs. 6300. It may apply for renewal for 10 consecutive years by paying 10 times that fee, to reach the authority at least 60 days before expiry.
