The First Schedule contains thirty-three Forms, PV-1 to PV-33, one for each application, notice or request that a party files under the Act and the Rules. Rule 2(e) defines "Form" as a Form in this Schedule, and rule 3 requires the particulars the Form asks for. Forms PV-5, PV-15, PV-16 and PV-17 were substituted by G.S.R. 494(E) of 15 June 2015. Portfolio owners can have our IP portfolio management team match each step to its Form.

Rules as amended up to G.S.R. 803(E) dated 16 November 2021. Later notifications should be checked on plantauthority.gov.in.

How the Forms are used

Rule 3(1) says that "every person making an application or representation under the Act or these rules, shall furnish the particulars in the Forms specified in the First Schedule". Rule 3(2) and (3) give one month's notice to supply missing particulars. Where no Form is specified, rule 3(4) allows the applicant to adopt a First Schedule Form "as nearly as may be". See rules 3 to 7.

Each Form states the proceeding in its heading, the person who signs, and the office of the Plant Varieties Registry at which it is lodged. Most Forms are addressed to the Registrar; some, after the 2015 amendment, to the Authority. Fees appear in the Second Schedule; a Form's own text does not state an amount. See the Second Schedule article.

Notes on selected Forms

PV-1 (authorisation). The person authorising names the person authorised to act on their behalf in filing a new, essentially derived or extant variety, asks that notices go to that person, and revokes any earlier authorisation for the same matter. It is addressed to the Registrar. See rules 24 to 27.

PV-2 (proof of right). The breeder or right holder declares that the applicant is their assignee or successor, lists the documents enclosed, and signs before two witnesses. The declaration is that the information is true to the signatory's knowledge and belief.

PV-3 and PV-4 (opposition and counter-statement). PV-3 gives notice of opposition to an application "published on" a stated date, with numbered reasons. PV-4 is the applicant's counter-statement, with grounds and a statement of which claims are admitted or disputed, and an address for communications in India. See rules 30 to 33.

PV-5 (extension of time), substituted in 2015. As substituted, PV-5 refers to rule 32. The signatory requests "extension of time for ... months under rule 32" for a stated filing, gives the application number and reasons, and an address for service in India. The 2003 Form referred to rule 33 and to extension of time "for filing notice of opposition/evidence/counter-statement".

PV-6 (renewal). The applicant applies for renewal of a registration by number and date, names the variety and denomination, and gives an address in India for the notice of renewal. The Form refers to rule 39(1)(b). See rules 37 to 39.

PV-15, PV-16 and PV-17 (revocation), substituted in 2015. PV-15 is an application by any person for revocation on one of the eight section 34 grounds, shown as separate points, with the applicant's relationship to the variety. PV-16 is the registered breeder's notice of opposition, with a written statement of the facts and grounds. PV-17 requests an opportunity of being heard, from the applicant or the opponent. All three are addressed to the Authority. See rules 50 to 53.

PV-32 (authorisation to sue). A breeder authorises a registered agent or licensee to act in "the particular matter or proceeding" stated, and revokes earlier authorisations for the same matter. It supports section 81 and rule 75.

PV-33 (certified copies). The applicant asks for a certified copy of stated entries or documents, or for inspection, and states the purpose. It is addressed to the Registrar and the Authority. Second Schedule entries 32 and 33 give the inspection and copy fees.

The Forms print declarations in the usual words; where this article mentions a declaration, it is the signatory's statement that the information is true to their knowledge and belief.

An invented example: a farmers' collective, a seed company and a university each use the table. The collective files Form PV-25 for compensation; the company files Form PV-6 to renew and Form PV-9 to register its distributor; the university files PV-3 to oppose a rival application. Each checks the Second Schedule for the fee and the rule for the period.
