Which year this governs

From the ICAI Guidance Note on Tax Audit (Revised 2026), Appendix XVI, cited at paragraph 22.2 — the Eleventh and, by ICAI's own statement, concluding edition under the Income-tax Act, 1961. The presumptive sections referenced are 44AD, 44ADA and 44AE of the 1961 Act; under the Income-tax Act, 2025 the corresponding provisions and the return form codes must be taken from that regime.

How the table is built

Every row has four parts: the Sector, the Sub-Sector, the Code, and an Applicability block of four columns — 44AD, 44ADA, 44AE and Others. The code is five digits: the first two identify the sector and the last three the sub-sector within it.

PrefixSectorPrefixSector
01Agriculture, animal husbandry & forestry13Financial intermediation services
02Fish farming14Computer and related services
03Mining and quarrying15Research and development
04Manufacturing16Professions
05Electricity, gas and water17Education services
06Construction18Health care services
07Real estate and renting services19Social and community work
08Renting of machinery20Culture and sport
09Wholesale and retail trade21Other services
10Hotels, restaurants and hospitality services22Extra territorial organisations and bodies
11Transport & logistics services23Activities of cooperative society
12Post and telecommunication services

The 04xxx manufacturing block is by far the largest, running from 04001 to 04099, and it is the one place where an auditor most often has to choose between several plausible business codes.

What the applicability columns of the business codes say

The code decides whether a presumptive claim is even arguable

Every row carries a tick or a cross against 44AD, 44ADA and 44AE. So the code the assessee selects is not a statistical label — it is a statement about which presumptive scheme can apply. A return claiming section 44ADA under a code whose 44ADA column is marked X contradicts itself on its face, and the tax auditor sees the same inconsistency at clause 10 read against clause 12.

PatternWhere it appears
44AD ✓, 44ADA ✗, 44AE ✗The default for the great majority of business codes — agriculture, manufacturing, construction, trade, hotels, education, most social, cultural and other services
44AD ✗, 44ADA ✓, 44AE ✗Professional activity: the 16xxx professions block (16001-16005, 16007-16009, 16013, 16018, 16019_1, 16020); healthcare practitioners at 18010 to 18020; software and IT professional codes 14001-14006 and 14008; and 20010 to 20012 — individual artists excluding authors, literary activities and other cultural activities n.e.c.
44AE ✓ alongside 44ADGoods carriage activity in the 11xxx transport block — 11002, 11008, 11010, 11011, 11012 and 11015 — and 08001 in the renting of machinery block
All three ✗09005 auctioneers; 16011 brokerage; and the entire 23001 to 23014 cooperative society block — only the "Others" column applies

Note the healthcare split: 18001 to 18009 — hospitals, nursing homes, diagnostic centres, laboratories, blood banks, medical transcription, ambulance services and medical suppliers — are business codes with a 44AD tick, while 18010 onwards — medical clinics, dental, Ayurveda, Unani, homeopathy, nursing and paramedical practice, veterinary practice, medical education, medical research and alternative medicine — carry 44ADA. The same activity delivered through an institution is a business; delivered by the practitioner it is a profession.

The codes added from A.Y. 2020-21

CodeActivityApplicability
16019_1Profession, applicable from A.Y. 2020-2144ADA
16020Artist, applicable from A.Y. 2020-2144ADA
20023_1Sports Management, applicable from A.Y. 2020-2144AD
21008_1Event Management, applicable from A.Y. 2020-2144AD

The underscore suffix marks a code inserted into an existing block without renumbering it. 16019 remains "other professional services n.e.c." with a 44AD tick, while 16019_1 sits beside it as a profession with a 44ADA tick — two adjacent business codes with opposite presumptive consequences.

The cooperative society block

Codes 23001 to 23014 are drawn along the lines of section 80P rather than by industry: banking or credit facilities to members, cottage industry, marketing of members' agricultural produce, purchase of agricultural implements and seeds for supply to members, processing without the aid of power, collective disposal of members' labour, fishing and allied activities, primary societies supplying milk, oilseeds, fruits or vegetables to a federal society, government, local authority, government company or statutory corporation, consumer cooperative societies and others outside section 80P(2)(a) and (b), interest or dividend from investment in another cooperative society, letting of godowns or warehouses, income from interest on securities or house property under section 80P(2)(f), and federal milk cooperative societies.

None of the three presumptive schemes is available to any of them — every row is marked X, X, X.

Where the business codes meet Form 3CD

ClauseConnection
Clause 10(a)Nature of business or profession — the description behind the code
Clause 10(b)Any change in the nature of business — a change of code between years is the visible symptom
Clause 12Profits assessable on a presumptive basis, with the section — must be a section the code permits
Clause 35Quantitative details, which are required for trading and manufacturing codes and marked "not applicable" for service codes
Clause 40Ratios, where a service provider furnishes only serial numbers 1 and 3
Section 44AB clause (d) / (e)The audit trigger itself, where income is claimed lower than the deemed profits under 44ADA or where section 44AD(4) applies
A wrong code can create — or hide — the audit obligation

Section 44AB(d) and (e) make the audit obligation depend on a presumptive claim. A professional who selects a business code with a 44AD tick, claims section 44AD instead of 44ADA and stays below the thresholds may never reach a tax audit at all; a business that selects a 44ADA code creates the appearance of one. The code is checked against the activity, not the other way round.

Worked example

AssesseeCode and consequence
Chartered accountant in practiceA 16xxx profession code; 44ADA available, 44AD not
Diagnostic laboratory run as a firm18005 — a business code with 44AD, not 44ADA
Consulting physician18010 medical clinics — 44ADA
Owner of eight goods carriagesAn 11xxx code with a 44AE tick
Software development company14001 — 44ADA column ticked; the scheme is still unavailable to a company, which the section decides, not the code
Commission auctioneer09005 — no presumptive scheme
Credit cooperative society23001 — no presumptive scheme
Event manager21008_1 from A.Y. 2020-21 — 44AD

Audit checklist

  • Match the code to the activity actually carried on, not to the one used last year.
  • Check the 44AD, 44ADA and 44AE columns against the presumptive claim at clause 12.
  • Use an n.e.c. code only where no specific sub-sector fits.
  • Distinguish institutional healthcare business codes from practitioner profession codes.
  • Use the A.Y. 2020-21 codes where they now describe the activity better.
  • Remember that the column is an activity test only — status, residence and the section's own conditions still govern.
  • Reconcile a change of code with the clause 10(b) answer.
  • Check consistency with clause 35 and the clause 40 ratios.

Common mistakes

  • Carrying forward last year's code after the activity has changed.
  • Claiming section 44ADA under a code whose 44ADA column is crossed.
  • Using an n.e.c. code where a specific sub-sector exists.
  • Treating a cooperative society as eligible for a presumptive scheme.
  • Reading a ticked column as conferring eligibility regardless of the assessee's status.

Key Facts About Business Codes

  • Applies in: All states across India, under the relevant central law.
  • Mode: Mostly online via the official government portal.
  • Typical timeline: Ranges from a few days to a few weeks depending on the case.
  • Non-compliance: May attract penalties, interest or late fees.

How is the code structured?

Each row gives a sector, a sub-sector and a five-digit code whose first two digits are the sector — 01 for agriculture, animal husbandry and forestry through to 23 for activities of a cooperative society.

What do the four applicability columns show?

Whether section 44AD, section 44ADA or section 44AE can apply to that activity, and an "Others" column which is ticked for every row.

Compliance is cheapest on the day it falls due and gets more expensive every day after.
