Reply to Section 156 Demand Notice

A reply to a Section 156 notice of demand responding to the tax demand and seeking rectification or stay of recovery.

Reply to Notice of Demand under Section 156

To,
The Assessing Officer,
[Ward / Circle], Income Tax Department, [City]

Ref: Notice of Demand No. [DIN / Notice Number] dated [DD/MM/YYYY] issued under Section 156 of the Income-tax Act, 1961

Subject: Reply to demand raised for Assessment Year [YYYY-YY]

Respected Sir/Madam,

I, [Name of Assessee], PAN [ABCDE1234F], am in receipt of the above notice of demand raising a sum of Rs. [Amount] for Assessment Year [YYYY-YY] pursuant to the order under Section [143(3) / 143(1)] dated [DD/MM/YYYY]. I respectfully submit my response as under.

On verification, the demand appears to have arisen due to [state reason, e.g. non-grant of TDS credit / mismatch in prepaid taxes / arithmetical error]. The taxes claimed are duly reflected in Form 26AS and the demand is, to that extent, not sustainable. I have accordingly filed a rectification application under Section 154 dated [DD/MM/YYYY].

I enclose herewith copies of Form 26AS, challans, TDS certificates and computation in support. Pending disposal of the rectification, I request that recovery of the disputed demand be kept in abeyance / stayed under Section 220(6).

Yours faithfully,

___
