Leave & License Agreement

A leave and license agreement under which the licensor permits a licensee to occupy premises without transferring any tenancy interest.

LEAVE AND LICENSE AGREEMENT

This Agreement is made on [Date] between [Lessor] and [Lessee]

  1. Parties. This Leave and License Agreement is between [Owner Name], R/o [Address] (the "Licensor") and [Occupant Name], R/o [Address] (the "Licensee").
  2. Property Description. The Licensor grants a license to use the premises at [Flat/Unit No., Building, City], admeasuring [Area] sq. ft., together with amenities and fixtures.
  3. Term / Duration. The license is granted for [11 months] from [Start Date] to [End Date], being terminable and renewable as provided herein.
  4. License Fee & Escalation. The Licensee shall pay a monthly compensation of Rs. [Amount] by the [5th] of each month, escalating [10]% on renewal.
  5. Security Deposit. An interest-free refundable deposit of Rs. [Amount] is paid, refundable on vacating after adjusting dues and damages.
  6. Use. The premises shall be used for [residential/office] use only. No tenancy, sub-tenancy or interest in the property is created by this license.
  7. Maintenance. The Licensee shall keep the premises in good condition; society/maintenance charges shall be paid by [Licensor/Licensee].
  8. Utilities. Electricity, water and other utility charges during the license period shall be borne by the Licensee.
  9. Lock-in. A lock-in of [6 months] applies during which the license shall not be revoked/surrendered without cause.
  10. Notice. Either party may terminate after lock-in by [one] month's written notice.
  11. Termination. On expiry or termination, the Licensee shall vacate and hand over peaceful possession without claiming any tenancy right.
  12. Stamp Duty & Registration. The Agreement shall be registered as required under State law; stamp duty and registration charges shall be borne by [Licensee].
  13. Governing Law. This Agreement is governed by Indian law and subject to the jurisdiction of courts at [City].
