Employment Agreement

A comprehensive employment contract that defines the terms of full-time employment between an employer and an employee in India.

EMPLOYMENT AGREEMENT

This Agreement is made on [Date] between [Employer Name], a company incorporated under the Companies Act, 2013, having its registered office at [Address] ("Employer"), and [Employee Name], residing at [Address] ("Employee").

  1. Appointment & Term. The Employer appoints the Employee to the position of [Designation] with effect from [Effective Date]. The employment shall continue until terminated in accordance with this Agreement.
  2. Probation. The Employee shall be on probation for [Number] months, extendable at the Employer's discretion, and shall be confirmed in writing on satisfactory performance.
  3. Duties & Reporting. The Employee shall perform the duties reasonably assigned, devote full working time to the Employer, and report to [Reporting Manager/Designation].
  4. Remuneration. The Employer shall pay a gross salary of Rs. [Amount] per annum, payable monthly, subject to statutory deductions including TDS, EPF and ESI as applicable.
  5. Working Hours & Leave. Standard working hours and leave entitlement shall be as per the Employer's policy and the Shops & Establishments Act of [State].
  6. Confidentiality. The Employee shall keep all proprietary and confidential information secret during and after employment and shall not use it for any purpose other than the Employer's business.
  7. Intellectual Property. All work product created during employment shall vest exclusively in the Employer.
  8. Non-Compete & Non-Solicit. During employment and for [Number] months thereafter, the Employee shall not engage in any competing business or solicit the Employer's clients or employees.
  9. Termination. Either party may terminate this Agreement by giving [Number] days' written notice or salary in lieu thereof. The Employer may terminate without notice for misconduct.
  10. Governing Law & Jurisdiction. This Agreement shall be governed by the laws of India and subject to the exclusive jurisdiction of the courts at [City].
  11. Dispute Resolution. Disputes shall first be resolved amicably, failing which they shall be referred to arbitration under the Arbitration and Conciliation Act, 1996, seated at [City].
