Tea Exporter Licence in brief

Talk to a Tea Licensing Expert

A Tea Exporter Licence is the business licence the Tea Board of India grants under the Tea (Distribution and Export) Control Order, 2005, made under section 30 of the Tea Act, 1953. Paragraph 3 of the Order says no exporter shall export tea — including imported tea — except under a business licence. A fresh exporter licence is valid for 3 years and can be renewed for further 3-year periods. An established exporter who meets the Order’s conditions can convert it into a Permanent Exporter Licence, which stays valid unless cancelled or suspended. Licence holders must file monthly export returns with the Tea Board.

What Is Tea Exporter Licence?

A quick, plain-language explanation before the details.

In simple terms

It is the Tea Board’s permission to run a tea-export business. Without it, commercial tea shipments cannot legally leave India.

Legally

Paragraph 3 of the Tea (Distribution and Export) Control Order, 2005 (S.O. 486(E), issued under section 30 of the Tea Act, 1953) prohibits any exporter from exporting tea or imported tea except under a business licence. Applications are made in Form A; renewals in Form J; conversion into a permanent business licence in Form B.

Governing authority

The Licensing Authority under the Order is the Chairman of the Tea Board of India (Ministry of Commerce & Industry). Applications are now filed online through the Tea Board’s e-governance portal, and the service is also listed on the National Single Window System.

Validity

A business licence for an exporter is valid for 3 years from issue and 3 years from each renewal. A permanent business licence remains valid unless cancelled or suspended. The Tea Board’s portal notes that a licence that has already expired cannot be renewed — a fresh licence must be taken.

Why it matters

Why Do Tea Exporters Need a Tea Board Licence?

Tea is one of the few commodities where the commodity board itself licenses every commercial exporter. Here is why the licence matters.

Talk to a Tea Licensing Expert →
  1. Legal Requirement to Export

The Control Order bars commercial tea exports — including exports of imported tea — without a Tea Board business licence.

  2. Avoid Stoppage of Shipments

The Board can direct Customs or port authorities not to allow a consignment where the Order is violated. A valid licence keeps shipments moving.

  3. Certificates of Origin

Licensed exporters can apply to the Tea Board for Certificates of Origin, including for GI teas such as Darjeeling, and for non-preferential origin.

  4. Path to a Permanent Licence

A clean compliance record and export track record let you convert to a permanent licence that no longer needs renewal.

  5. Buyer & Bank Confidence

Overseas buyers, banks and inspection agencies routinely ask for the Tea Board licence before contracting or financing tea shipments.

  6. Foundation for RCMC & Schemes

The exporter licence sits alongside your Tea Board RCMC, which is needed for Foreign Trade Policy benefits and Tea Board export-promotion schemes.

Answers

Frequently Asked Questions

What is a Tea Exporter Licence?
It is the business licence the Tea Board of India grants to exporters under the Tea (Distribution and Export) Control Order, 2005. Paragraph 3 of the Order says no exporter shall export tea, including imported tea, except under such a licence.
Who needs a Tea Board exporter licence?
Anyone exporting tea commercially — tea estates, manufacturers, blenders, packers, merchant exporters and trading houses. It also covers businesses that import tea and then export it after blending or packing.
Are any tea exports exempt from the licence?
Yes. The Order does not require a licence for tea exported by or for the Central Government or the Tea Board, tea sent by postal parcel, tea carried as a passenger’s personal effects, tea sent for non-commercial purposes, and samples sent to foreign buyers.
What is the validity of a Tea Exporter Licence?
A fresh exporter licence is valid for 3 years from the date of issue. Each renewal keeps it valid for a further 3 years, unless it is cancelled or suspended in between.
What is a Permanent Tea Exporter Licence?
It is an exporter licence converted into a permanent business licence under paragraph 8(3) of the Order. It stays valid unless cancelled or suspended, so no periodic renewal is needed.
Who can get a Permanent Tea Exporter Licence?
The Order allows conversion where the licensee is an exporter, has not violated the Tea Act, Tea Rules, Bye-laws or any Order under the Act, and meets the export-volume track record set in the Order for the preceding three years. We check the current criteria with you before applying.
When should I apply for the permanent licence?
The Order requires the conversion application to be made three months before the expiry of your current business licence. If you miss that window, you would renew the 3-year licence instead.
Can a permanent licence be cancelled?
Yes. The Licensing Authority can cancel or suspend it after a hearing — for example, for misrepresentation, breach of contract with a foreign buyer, violating the Act or Order, or if the holder has not exported any tea during three consecutive preceding years.
Can I renew an expired Tea Board licence?
The Tea Board’s online portal FAQ states that a licence that has already expired cannot be renewed, and a fresh licence must be applied for. We track your expiry date so renewal is filed in time.
What returns does a tea exporter licensee file?
The Tea Board’s guidelines require a monthly export return, category-wise and type-wise, by the 15th of the following month — with a nil return in months with no exports. Not filing can lead to suspension or cancellation of the licence.
What is the government fee for a Tea Exporter Licence?
The Tea Board’s published guidelines list ₹1,000 for a fresh 3-year exporter licence, ₹1,000 for renewal and ₹2,500 for a permanent exporter licence. The fee is paid online at filing; we confirm the current amount on the portal. Our professional fee is quoted separately.
Is IEC required for a Tea Exporter Licence?
Yes. A copy of your Import Export Code is one of the documents the Tea Board asks for, and its address should match the address in your application.
Is the exporter licence the same as the Tea Board RCMC?
No. The exporter licence is a statutory permission under the Control Order. The RCMC is a registration-cum-membership certificate used for Foreign Trade Policy benefits. Most tea exporters hold both.
Can I export imported tea under this licence?
Yes, but the Order adds conditions — imported tea meant for export must be exported within six months of import and must achieve at least 50% value addition, calculated as set out in the Order.
Can I transfer my tea exporter licence to a buyer of my business?
No. The licence is personal to the licensee and cannot be sold or transferred. A purchaser or transferee of the business must obtain a fresh licence.
