The Second Schedule lists the forms an applicant or party files; the Third Schedule lists the forms the Registrar issues. Rule 11 requires the Second and Third Schedule forms to be used in all cases to which they apply. This article sets out each form, the section and rule it serves and its fee entry in the First Schedule as substituted in November 2025.

What rule 11 says about forms

Rule 11(1): the forms in the Second and Third Schedules "shall be used in all cases to which they are applicable and may be modified as directed by the Registrar to meet other cases". Rule 11(2): any form filed at the Registry "shall be accompanied by the prescribed fee". Rule 11(3): the requirement is satisfied by "a replica of that form or of a form which is acceptable to the Registrar and contains the information required". Rule 11(4): the Registrar may, after notification in the Journal, require forms in machine-readable form. The Act's power to make these rules is explained in our article on sections 86 and 87 of the GI Act.

Rule 2(1)(k) says forms are in the Second or Third Schedule only. The Schedules also use "Part" letters (A, B, C and so on) inside one form number. The fee for each entry is in our article on the First Schedule.

Applicants who are unsure which form and part to use often take advice from a geographical indication registration adviser before filing, since a wrong form is a wrong filing.

What the 2020 amendment did to the forms

The Amendment Rules, 2020 (G.S.R. 528(E), 26 August 2020) made three changes to this Schedule:

  1. The row "GI-3, section 18(5), rule 59, request for issuance of a registration certificate as an authorised user, 3B" was omitted.
  2. The row for renewal of an authorised user (section 18(2), rule 60(1)) now carries entry number 3B instead of 3C.
  3. The old Form GI-3 was substituted by two forms: Form GI 3A, "Application for the Registration of an Authorized User ", and Form GI 3B, "Application for Renewal of Registration of an Authorized User ".

Form GI 3A asks for the applicant's name and address, address for service, the registered geographical indication, email and phone, and carries a declaration that the statement of case and evidence of due service of a copy on the registered proprietor are enclosed. Form GI 3B asks for similar details and a declaration that registration after renewal is valid for ten years or for such period as the geographical indication continues to be registered, whichever is lesser. The fee for both is entry 3A and 3B respectively, Rs. 10 each, as per the First Schedule as substituted in November 2025. Rules 56(1) and 60(1) and some other places still say "Form GI-3"; read them as GI 3A or GI 3B. See our article on authorised user rights.

Slips in the Second Schedule list

  • Search and division. The list shows search as 5E and division as 5F. The First Schedule and the form show division as 5E and search as 5F.
  • Review. The list gives "63, rule 92" for review; rule 92 itself cites clause (c) of section 60.
  • Change of name. The list gives "28 (c)" for entry 5B; the form says section 28(b).
  • Entry 7A. The list says "other than a certificate under Section 16(2)"; the 2025 First Schedule says "other than a certificate under section 69 or Section 78(1)".
  • Form GI-4 A prints "Rule 61", while renewal is rule 60.
  • Form GI-8 A prints "trade marks agent" and "Rules, 2000", and Form GI-8 D refers to removal "under rule 113" (the removal rule is rule 111).

What each says, in the text of the Schedule:

Form O-1. Notice, as required by section 16(3), that registration "has not been completed by reason of default on the part of the applicant". "Unless registration is completed within twenty-one days from the date of this notice, the application will be treated as abandoned." See our article on section 16 of the GI Act.

Form O-2. Certificate of registration of a geographical indication under section 16(1) or "of unauthorised user under section 17(3)(e)". The form certifies registration "in the name of ... in Class ... under No. ... as of the date ...", states that registration is for ten years and may then be renewed for ten years and at the end of each ten years, and says the certificate "is not for use in legal proceedings or for obtaining registration abroad". The words "unauthorised user" in the heading are a slip for "authorised user".

Form O-3 and Form O-5. Notices of expiration under section 18(4), for a geographical indication and for an authorised user. The printed fee in each is out of date. See our article on rule 61. The Third Schedule list gives "Rule 55(1)" for O-5, but the notice is the rule 61 notice.

Form O-4. Certificate of registration as a geographical indications agent; the list says rule 102 but rule 109 provides for it.

Using the lists

  1. Identify the matter and the rule that governs it.
  2. Find the form and part in the table above.
  3. Check the First Schedule entry for the amount and any two-rate entry.
  4. Use the form as it stands, and read old "Form GI-3" references as GI 3A or GI 3B.
  5. Check later amendments for changed forms.

Amendments made after November 2025 should be checked before acting.
