Service Overview

What is a Geographical Indication?

A Geographical Indication (GI) is a sign used on goods that originate from a specific geographical area and possess qualities, reputation, or characteristics essentially attributable to that origin. Think Darjeeling Tea (India’s first registered GI), Banarasi saree, Mysore silk, Alphonso mango, and Basmati rice — the place name itself signals authenticity and quality.

GIs in India are governed by the Geographical Indications of Goods (Registration and Protection) Act, 1999 read with the GI Rules, 2002, and are registered at the Geographical Indications Registry, Chennai. TaxClue manages the entire journey — producer documentation, statement of case, Form GI-1 filing, examination responses, and authorised user registration.

⚠️

Who Can Apply — Important

An individual trader cannot apply for a GI. Only an association of persons or producers, or an organisation or authority established by law representing the interests of producers of the goods can file. Once registered, individual producers can join as authorised users.

Frequently Asked Questions

GI Registration — Questions Answered

No. Under the GI Act, 1999, only an association of persons or producers, or an organisation or authority established by law representing the interests of the producers, can apply. An individual producer benefits by registering as an authorised user after the GI is registered.
A trademark identifies the goods of one business and can be sold or licensed. A GI identifies goods from a geographical region, belongs to the producer community collectively, and cannot be assigned, transmitted, or licensed. A business in the region can hold both — its own trademark plus authorised-user rights in the GI.
10 years, and it can be renewed indefinitely for successive 10-year periods on payment of the renewal fee. If renewal is missed, the GI is liable to be removed from the register, so timely renewal matters.
A producer of the GI goods within the defined region can register as an authorised user of the registered GI. Registration gives the producer the exclusive statutory right to use the GI on their goods and the standing to act against infringement — essential for weavers, farmers, and artisans selling under the GI name.
No. The GI Act expressly prohibits assignment, transmission, licensing, pledge, or mortgage of a GI — it is a collective community right, not private property of any one entity. This is a key difference from trademarks and patents.
Goods only, not services — agricultural goods (tea, rice, mangoes), natural goods, and manufactured goods including handicrafts, textiles, and foodstuffs. The quality, reputation, or characteristic must be essentially attributable to the geographical origin.
Form GI-1 must be supported by a statement of case (how the GI serves to designate the goods and its unique characteristics), the class of goods, a map of the production territory, proof of origin (historical evidence), the method of production, and details of the inspection/quality-control structure. This drafting is the heart of a successful application.
Darjeeling Tea — the first product to receive GI registration in India after the GI Act came into force. Since then hundreds of Indian products, from Banarasi sarees to Mysore silk and Alphonso mangoes, have been registered.
