Under the Companies (Incorporation) Rules, 2014 (Companies Act, 2013), a proposed name must not be identical or too similar to an existing company, LLP or registered trademark, must reflect the company’s objects, and must not be undesirable or prohibited under the Emblems and Names (Prevention of Improper Use) Act, 1950.
Administered by the Ministry of Corporate Affairs (MCA) via the MCA21 portal — the RUN and RUN-LLP web services, and SPICe+ Part A for new company incorporation.
An approved name is reserved for 20 days for a new company (to file incorporation) and 60 days for a change of name of an existing company. If unused, the name lapses and a fresh application is required.

The proposed name should indicate the company’s main business activity. A name that does not reflect the objects is often marked for resubmission with a justification.
