A Non-Resident Taxable Person (NRTP) is anyone who occasionally supplies goods or services in India but has no fixed place of business or residence in India (Section 2(77), CGST Act). Under Sections 24 & 27 registration is compulsory regardless of turnover — there is no threshold exemption. An NRTP applies on Form GST REG-09, which is not PAN-based: it uses the passport or the tax identification number of the home country. The application must be filed at least 5 days before commencement of business, an advance deposit of the estimated tax liability must be paid before the certificate issues, and the registration is valid for 90 days (extendable once by a further 90 days on Form REG-11). The government fee is ₹0.
90 days
Default validityAn NRTP registration is valid for the period requested, up to 90 days, and can be extended once by a further 90 days on Form REG-11 with an additional advance deposit.
Understand It

What Is Non-Resident Taxable Person?

A quick, plain-language explanation before the details.

In simple terms

A Non-Resident Taxable Person (NRTP) registration lets a foreign business legally supply goods or services in India for a short period — such as an exhibition, a project or a one-off contract — without setting up a company or permanent office here.

Legally

Under Section 2(77) of the CGST Act, 2017, an NRTP is a person who occasionally undertakes transactions involving the supply of goods or services, whether as principal or agent, but has no fixed place of business or residence in India. Section 24 makes registration compulsory regardless of turnover, and Section 27 sets the special validity and advance-deposit rules.

Governing authority

Administered by the Goods and Services Tax Network (GSTN) under the Central Board of Indirect Taxes and Customs (CBIC), via gst.gov.in. The application is made on Form GST REG-09.

Validity

Valid for the period stated in the application, up to a maximum of 90 days, and extendable once by a further 90 days on Form GST REG-11 with an additional advance deposit.

Who Must Register?

An NRTP must register regardless of turnover — there is no threshold exemption. Registration is compulsory under Section 24 whenever a foreign supplier makes taxable supplies in India without a fixed establishment here.

Who / WhatRequirement
Foreign business with no fixed place of business in IndiaRegister as NRTP — no threshold
Occasional / project-based supply of goods or services in IndiaRegister before commencement
Exhibitions, trade fairs, demos, short contracts by overseas suppliersRegister as NRTP
Overseas supplier with a fixed establishment or residence in IndiaRegister as a regular taxpayer instead
TimingApply at least 5 days before commencing business

An NRTP is distinct from a Casual Taxable Person (CTP): a CTP has a PAN and a place of business somewhere in India but supplies occasionally in another state, whereas an NRTP has no fixed place of business or residence in India at all and registers on a non-PAN basis.

Good to know before you register

No PAN required

Form REG-09 is not PAN-based. A non-resident applies using a self-attested copy of the passport, or the tax identification number / unique number issued by the home country government.

Rule 13, CGST Rules

India-resident signatory is mandatory

The NRTP must appoint an authorised signatory who is resident in India with a valid PAN. This person signs the application and manages compliance on the NRTP's behalf.

Advance deposit is a pre-condition

A temporary reference number is issued first; the certificate is granted only after depositing an advance amount equal to the estimated net tax liability for the registration period.

Apply 5 days ahead

The application on REG-09 must be submitted at least 5 days before the NRTP commences business in India.

Why It Matters

Why Is NRTP Registration Required?

A foreign supplier without an Indian establishment cannot register as a regular taxpayer, yet still creates a GST liability the moment it supplies in India. NRTP registration is the compliant route.

  1. 01

    Compulsory Under Section 24

Registration is mandatory for a non-resident taxable person regardless of turnover. There is no threshold exemption — the liability arises from the supply itself, not from crossing a turnover limit.

  2. 02

Supply in India Without an Office

NRTP registration lets a foreign business supply goods or services in India for a defined period without incorporating a company or establishing a permanent office here.

  3. 03

    Raise Valid GST Invoices

With a GSTIN the NRTP can issue GST-compliant tax invoices, so Indian B2B customers can claim their own eligible input tax credit on the supply.

  4. 04

    Discharge Tax Correctly

The advance-deposit mechanism ensures the estimated tax for the period is secured upfront, and the NRTP files GSTR-5 to reconcile actual supplies and tax paid.

  5. 05

    Avoid Penalty Exposure

Supplying in India while unregistered exposes the foreign supplier to penalties under Section 122 and blocks the ability to collect GST or pass on input tax credit.

  6. 06

    Local Signatory Handles Compliance

A mandatory India-resident authorised signatory gives the tax administration a local point of contact, so filings and any officer queries are handled within India.

What Documents Are Required for NRTP Registration?

An NRTP applies on a non-PAN basis. Keep clear scans (PDF/JPG) of the passport or home-country tax ID, the entity registration, and the India-resident signatory's documents ready.

Choose a document group

Non-Resident Entity

Foreign company / firm
4 documents
  • Self-attested copy of passport, or tax identification / unique number of the home country
  • Certificate of incorporation / registration of the foreign entity
  • Proof of home-country address of the entity
  • Estimated tax liability for the registration period (for advance deposit)
Important before you file

Passport, not PAN

Form REG-09 is filed with a self-attested passport copy or the home-country tax identification number — a PAN is not required for the non-resident entity itself.

Rule 13, CGST Rules

Signatory must be in India

The authorised signatory must be resident in India and hold a valid PAN. The application is verified through this signatory's credentials.

Estimate your tax to deposit

Have a realistic estimate of the net tax liability for the period ready — the advance deposit is based on it and must be paid before the certificate is issued.

File 5 days in advance

Submit REG-09 at least 5 days before you begin supplying in India so the certificate can be granted in time.

Documents may need attestation

Foreign incorporation and identity documents may need to be self-attested (and, where the officer requires, notarised / apostilled). Keep legible colour scans.

Answers

Frequently Asked Questions

Who is a Non-Resident Taxable Person (NRTP) under GST?
Under Section 2(77) of the CGST Act, an NRTP is a person who occasionally supplies goods or services in India — as principal, agent or in any other capacity — but has no fixed place of business or residence in India. Foreign companies, firms and individuals making short-term taxable supplies in India typically register as NRTPs.
Is there a turnover threshold for NRTP registration?
No. Section 24 makes registration compulsory for a non-resident taxable person regardless of turnover. There is no threshold exemption — an NRTP must register before making any taxable supply in India.
Which form is used for NRTP GST registration?
An NRTP applies on Form GST REG-09. Unlike normal registration it is not PAN-based: the application uses a self-attested copy of the passport, or the tax identification number / unique number issued by the government of the home country.
Does an NRTP need a PAN?
No. The non-resident entity itself does not need an Indian PAN to register — the passport or a home-country tax identification number is used instead. However, the mandatory authorised signatory who is resident in India must have a valid PAN.
What is the advance deposit for NRTP registration?
Before the registration certificate is granted, an NRTP must pay an advance deposit of tax equal to the estimated net tax liability for the period of registration. The amount is credited to the electronic cash ledger and used to pay tax on supplies during the period; any unused balance can be refunded after returns are filed.
How long is an NRTP registration valid?
It is valid for the period stated in the application, up to a maximum of 90 days. If the NRTP needs more time, the registration can be extended once by a further 90 days by filing Form GST REG-11 before expiry, along with an additional advance deposit for the extended period.
When must an NRTP apply for registration?
The application on Form REG-09 must be filed at least 5 days before the non-resident taxable person commences business in India. Applying in advance ensures the GSTIN and certificate are in place before supplies begin.
Does an NRTP need an authorised signatory in India?
Yes. An NRTP must appoint an authorised signatory who is resident in India and holds a valid PAN. This person signs the application and manages the NRTP's GST compliance, including returns, within India.
Which returns does an NRTP file?
A Non-Resident Taxable Person files Form GSTR-5 monthly (or for the period of registration), reporting outward supplies and tax. Because an NRTP cannot generally claim input tax credit in the normal way, GSTR-5 primarily captures the supplies made and tax discharged during the validity period.
What is the difference between an NRTP and a Casual Taxable Person (CTP)?
A Casual Taxable Person has a PAN and a fixed place of business somewhere in India but supplies occasionally in a state where they have no fixed place. A Non-Resident Taxable Person has no fixed place of business or residence in India at all and registers on a non-PAN (passport / tax-ID) basis on Form REG-09. Both require an advance deposit and have 90-day validity.
Can an NRTP claim input tax credit?
An NRTP generally cannot claim input tax credit, except that credit is available on goods imported by the NRTP. The advance deposit and GSTR-5 mechanism is designed so the estimated output tax is secured and discharged for the short registration period.
What happens when the NRTP registration expires?
The registration lapses at the end of its validity (or the extended validity). The NRTP files the final GSTR-5, and any balance in the electronic cash ledger over and above the tax due can be claimed as a refund. If activity continues, a REG-11 extension must be filed before expiry.
Is NRTP registration free?
Yes — the government charges no fee to file the registration on the GST portal. You only pay a professional fee if you use an expert or a service like TaxClue to estimate the deposit, appoint the signatory, file REG-09 and handle GSTR-5 and any extension.
How does a foreign company register as a non-resident taxable person in India?
A foreign company files Form GST REG-09 on gst.gov.in at least 5 days before commencing business in India, using a self-attested passport or a home-country tax identification number instead of an Indian PAN. It appoints an India-resident authorised signatory with a valid PAN, pays an advance deposit of the estimated tax, and on approval receives the GSTIN and REG-06 certificate.
When is Form GSTR-5 due for a non-resident taxable person?
An NRTP files Form GSTR-5 by the 13th of the month following the tax period, or within 7 days after the last day of the registration validity, whichever is earlier. It reports the outward supplies made and tax paid during the short registration period.
Can a non-resident taxable person extend the registration beyond 90 days?
Yes. If the NRTP needs to continue supplying in India beyond the initial period, the registration can be extended once by up to a further 90 days by filing Form GST REG-11 before the current validity expires, along with an additional advance deposit for the estimated tax of the extended period.
