Rajasthan explained: this guide covers what it means, who it applies to, the step-by-step process, documents required, fees, due dates and penalties in India — so you can stay compliant with confidence and avoid costly mistakes.
Under the Rajasthan OSH Rules, registration and licensing run on an Official Portal, with fees set by tables printed in Chapter II. An employer or factory occupier needs to know which Form to file, how fees are scaled, when a renewal is due and what happens if the registering officer is silent. This article covers rules 1 to 27.
Registration is applied for electronically in Form-1 on the Official Portal; the certificate in Form-2 is auto-generated and deemed registered if not issued within the time allowed (rule 5). A factory licence may be for a period not exceeding 10 years, renewal applications are due not later than 31 January of the expiry year (rules 6 and 12) and an appeal against the registering officer lies within thirty days (rule 27). Late fees are 25 percent (rules 7 and 26).
Which rule set this is
These are the Rajasthan Occupational Safety, Health and Working Conditions Rules, 2026, as notified by S.O.23 dated 30 June 2026 in the Rajasthan Gazette Extraordinary of the same date. Later amendments and State notifications under these rules should be checked in the State Gazette.
The notification recites that a draft was published on 3 February 2026 under sections 133(1), 135(1) and 137 of the OSH Code, 2020 and that objections were considered; the rules are made under sections 133 and 135. Rule 1(3) reads: "They shall come into force from the date of their publication in the Official Gazette." Rule 2(1)(t) defines the "Official Portal" as the LDMS web application of the Labour Department and the RajFAB web application of the Factories and Boilers Inspection Department, or any other official website of the State Government. Registration under the Code is deemed registration under the Rajasthan Shop and Commercial Establishment Act, 1958 (proviso to rule 5(13)).

The occupier applies electronically in Form-1 (registration) and Form-5 (licence), or through the Rajasthan Enterprises Single Window Enabling and Clearance Act, 2011, for a single or common licence for a period not exceeding 10 years. The fee is online, per Fees Table-A (factories other than electricity generating, transforming or transmitting factories) or Fees Table-B (electricity factories). Table-A is a grid of installed horse power against the maximum number of persons employed on any day in the year. For a factory with installed horse power up to nil, the printed annual fee row reads: up to 09 persons Rs 400; 10 to 20, Rs 800; 21 to 50, Rs 1600; 51 to 100, Rs 3400; 101 to 250, Rs 4800; 251 to 500, Rs 8200; 501 to 750, Rs 12400; 751 to 1000, Rs 18200; 1001 to 1500, Rs 20600; 1501 to 2000, Rs 24800; 2001 to 3000, Rs 33000; above 3000, Rs 41400. Other horse power bands carry higher amounts; read the full grid in rule 6(2). At registration, 50% of one year's fees is also payable. Table-B has separate columns for generating stations and transforming (including converting) stations by installed capacity in K.W., and transmitting stations pay Rs. 6900. The late fee under the proviso to section 3(1) is 25 percent of the licence fee (rule 7).
Plans, stability and licence conditions (rules 8 to 12)
- Plans (rule 8). No factory site may be used, and no building constructed, extended or taken into use, without prior written permission of the Chief Inspector-cum-Facilitator, on Form-6 through the Official Portal. A factory employing up to 50 workers with a non-hazardous process also files Form-7 with Form-6. Third-party-certified plans may be accepted for classes the State Government specifies.
- Stability (rule 9). No manufacturing process in a new or extended building until the Form-8 certificate of stability is sent and accepted.
- Licence needed (rule 10). A valid application with fee paid on the Official Portal deems the premises licensed until the licence is granted, renewed or refused in writing.
- Grant (rule 11). A single licence in Form-9 or a common licence in Form-10 for a period not exceeding 10 years; every licence remains in force until the 31st day of March next following unless renewed.
- Renewal (rule 12). Form-5 on the portal not later than 31st January of the year the licence is due to expire; a factory starting on or after 1 February applies on or before 1 April next following; licence auto-generated on complete application and fees; late renewal costs an additional 25 percent of the fee per year.
Amendment, transfer, closure (rules 13 to 18)
Amendment is on Form-5; the licence amendment fee is one hundred rupees plus any excess of the fee that would have been payable in the amended form, and the registration amendment fee is one hundred rupees (rule 13). Change of manager is on Form-11 (rule 14). The Chief Inspector-cum-Facilitator may revoke a licence for fraud or misrepresentation or imminent danger, after a hearing (rule 15). Transfer is on Form-5 with a Form-9 licence issued, at one hundred rupees plus the excess (rule 16). A closed factory's licence may be suspended or cancelled, and a suspended licence is renewed on Form-5 with a surcharge of 10 percent of licence fees (rule 17). Under rule 18 the Form-4 notice of commencement or cessation is within thirty days, with a certificate of payment of all dues and that the premises are kept clear of storage of hazardous chemicals on cessation. The Central rule is in notice of commencement and cessation.

Appeal (rule 27)
An aggrieved occupier or employer may appeal electronically to the appellate officer notified by the State Government within thirty days of receiving the registering officer's order. If the appellant does not appear, the appeal may be dismissed for default, but restoration may be sought electronically within thirty days. The order is to be disposed of within thirty days from receipt of the appeal.
A worked example
Mewar Plastics, a Udaipur factory with 120 workers, applies on Form-1 and Form-5 on the Official Portal with the fee proof. If the certificate is not issued within the allowed time, it is deemed registered. The licence is taken for five years; HR manager Jyoti notes that renewal must be filed not later than 31 January of the expiry year, otherwise the late fee of 25 percent of the yearly fee applies.
Common lapses
- Not updating particulars on the Official Portal within thirty days of a change in ownership or management.
- Filing a renewal after 31 January without budgeting the 25 percent late fee.
- Starting building work before the Chief Inspector-cum-Facilitator permits the plans.
- Filing a cessation notice without the certificate of payment of dues.
- Appealing after thirty days from receipt of the order.
