Rajasthan explained: this guide covers what it means, who it applies to, the step-by-step process, documents required, fees, due dates and penalties in India — so you can stay compliant with confidence and avoid costly mistakes.
When an inspector reports a violation, Rajasthan's OSH Rules provide a short route: a penalty enquiry before a designated officer, an appeal in Form-35 within two months, and, for compoundable offences, a notice and payment within fifteen days. This article covers rules 118 to 130 and then lists every Form printed with the rules.
The penalty officer passes a speaking order within fifteen days of the hearing (rule 118). An appeal lies in Form-35 within two months, with a fee of one percent of the penalty under appeal (rule 119). A compounding notice is answered by depositing the whole amount within fifteen days of receipt, and the certificate follows within ten days (rule 120). Where no appeal fee is prescribed, the fee is Rs. 100 (rule 126).
Which rule set this is
These are the Rajasthan Occupational Safety, Health and Working Conditions Rules, 2026, as notified by S.O.23 dated 30 June 2026 in the Rajasthan Gazette Extraordinary of the same date. Later amendments and State notifications under these rules should be checked in the State Gazette. Rule 1(3) says they come into force "from the date of their publication in the Official Gazette". The registration chapter is in notification and registration of establishments.
If a penalty order or compounding notice has been served, our legal consultation service can review the papers. The Central rules are explained in manner of holding enquiry. The rules themselves print no penalty amounts; the Code's penalty provisions apply.
Enquiry into penalty (rule 118)
The officer appointed by the State Government to impose penalty acts on details of violations under section 111(1) received from the Inspector-cum-Facilitator. He summons the employer, occupier or manager and the Inspector-cum-Facilitator to give evidence and produce documents. After hearing the parties he records the proceedings and, within fifteen days, passes a speaking order imposing penalty or discharging the employer or manager, with a copy delivered to both parties electronically.

The Central rule is in manner of compounding of offences. Rule 120 prints no amount; the compounding amount is stated in the notice.
Social Security Fund (rule 121)
The State's Social Security Fund under section 115(1) is funded by the amount received from composition of offences under section 114(4), the penalty amount under section 111(6) and other sources specified by the State Government from time to time. It is administered and expended for the welfare of unorganised workers in the manner the State Government specifies. Employers do not pay into it directly under this rule. See the Central Social Security Fund rule.

A worked example
Marudhar Foundry of Bhilwara receives a compounding notice for a compoundable offence reported by the Inspector-cum-Facilitator. Its manager, Vishal, applies electronically and pays the whole amount within fifteen days of receipt. The officer issues the composition certificate within ten days of receiving the money. Had Vishal not paid, prosecution could proceed before the Court. In an unrelated matter where a penalty order was passed, the company files Form-35 within two months, with one percent of the penalty as fee.
Common lapses
- Missing the fifteen-day window to pay a compounding amount.
- Filing a penalty appeal after two months or without the one percent fee.
- Not asking for the inspection note handed over at the end of an inspection.
- Continuing to apply the repealed Rajasthan Factories Rules, 1951.
- Using a form number from memory instead of the printed list.
