Rajasthan explained: this guide covers what it means, who it applies to, the step-by-step process, documents required, fees, due dates and penalties in India — so you can stay compliant with confidence and avoid costly mistakes.
Chapters III and IV of the Rajasthan OSH Rules put specific tasks on the employer: an annual health check, an appointment letter, prompt notice of accidents and diseases, a safety committee in larger establishments and safety officers in numbers fixed by tables. This article follows rules 28 to 41.
Employees who have completed 40 years of age get an annual medical examination, arranged at no charge to them, within 120 days from the start of the calendar year (rule 28). A fatal accident is notified in Form-13 forthwith; a lost-time injury within twelve hours after 48 hours of disability (rule 30). A safety committee is required in an establishment employing 500 or more workers (rule 35), and safety officers are appointed as per the norm tables in rule 38.

These are the Rajasthan Occupational Safety, Health and Working Conditions Rules, 2026, as notified by S.O.23 dated 30 June 2026 in the Rajasthan Gazette Extraordinary of the same date. Later amendments and State notifications under these rules should be checked in the State Gazette. Rule 1(3) says they come into force "from the date of their publication in the Official Gazette". Registration and fees are covered in the first article of this series, notification and registration of establishments.

Health examination (rule 28)
Every employer of a factory, beedi and cigar works or building and other construction work arranges the medical examination at no cost to the employee, for each employee who has completed 40 years of age, within 120 days from the commencement of the calendar year. The qualified medical practitioner fills Form-12 and submits the certificate to the employer or occupier and to the employee. The employer may use ESIC facilities available under the Central Code on Social Security rules.
Appointment letter (rule 29)
No employee is employed unless a letter of appointment has been issued in the format printed in the rule: name, date of birth, parent's name, Aadhar number, Labour Identification Number of the establishment, UAN or ESIC insurance number if available, designation, category of skill, date of joining, wages, basic or pay and dearness allowance, other allowances including accommodation, avenue for higher wages or position, applicability of EPFO and ESIC benefits, the broad nature of duties and any other information, signed by the occupier, employer, owner, agent or manager. An employee without such a letter is issued one within three months of the rule coming into force. The Central rule is in letter of appointment to employee.
Accident and disease notices (rules 30 and 31)
For a fatal accident in a factory, beedi and cigar works, or building or construction work, the Form-13 notice goes forthwith to the Inspector-cum-Facilitator, Chief Inspector-cum-Facilitator concerned, District Magistrate or Sub-Divisional Officer and the officer-in-charge of the nearest police station, and the family or kin are informed. A telephone call also goes to those officers. If a person is prevented from working for forty eight hours or more, Form-13 is sent electronically to the Inspector-cum-Facilitator within twelve hours after completing forty eight hours. A dangerous occurrence on the printed Schedule, whether or not anyone is hurt, is notified in Form-13 within twelve hours to the Inspector-cum-Facilitator and District Magistrate or Sub-Divisional Officer. If death follows after notices, telephone and electronic notice goes forthwith, confirmed in writing within twelve hours of the death. If the 48-hour disability arises later in more than one spell, report within 24 hours of the total reaching 48 hours. The Schedule lists twelve classes including bursting of pressure plant, collapse of cranes or hoists, explosion or toxic gas release, collapse of structures, and major uncontrolled emission or chemical spillage. The Central rule is in notice of accidents and dangerous occurrences.
Rule 31 requires a printed notice of disease to be sent electronically by the employer, occupier or manager where a disease listed in the Third Schedule to the Code occurs; a medical practitioner attending a suspected case reports in writing to the Chief Inspector-cum-Facilitator.
Employees' duties and rights (rules 32 and 33)
Employees report unsafe or unhealthy conditions as soon as practicable, and a safety officer, manager or supervisor passes the report to the employer. Employees may not refuse training required under the Code. On information of imminent danger, the employer or occupier takes immediate remedial action and sends a report forthwith to the Inspector-cum-Facilitator.
State Advisory Board (rule 34)
The Rajasthan State Occupational Safety and Health Advisory Board is chaired by the Principal Secretary or Secretary, Labour Department, with the Chief Inspector-cum-Facilitator as Member Secretary, other ex-officio members, institutional representatives, two employer and two worker representatives and four safety and health experts. It meets at least once a year.
Safety committee (rules 35 to 37)
An establishment or factory employing 500 or more workers, and any establishment required by an order under section 22(1), constitutes a safety committee. Its maximum tenure is three years and it meets at least once in every quarter. The committee has equal employer and worker members, not exceeding twenty. Management members are a senior official as Chairman, a Safety Officer and Medical Officer where available (the safety officer as Secretary) and a representative each from production, maintenance and purchase. Worker members are nominated by the negotiating union or council or chosen by workers, with adequate representation of women; a dispute goes to the concerned Joint, Deputy or Assistant Labour Commissioner, whose decision is final. Minutes are recorded and produced to the Inspector-cum-Facilitator on demand, and the employer implements recommendations within 15 days of receiving them. Rule 37 lists its functions, including discussing remedial measures, reviewing new installations, discussing accident reports, safety campaigns and complaints of imminent danger. See also the Central safety committee rule.

A worked example
Bharat Chemicals of Kota employs 900 workers and carries on a hazardous process. Under rule 38(B) it needs two safety officers (501 to 1000 workers). Its HR head, Tarun, sets a quarterly safety committee calendar, records minutes and acts on recommendations within 15 days. When a fitter is hurt and cannot work for forty eight hours, he files Form-13 with the Inspector-cum-Facilitator within twelve hours after the forty eighth hour.
Common lapses
- Holding the annual medical examination after the 120 days, or skipping employees who have turned 40.
- Missing the twelve-hour windows for Form-13.
- Leaving women under-represented on the safety committee.
- Counting safety officers by the non-hazardous table where a hazardous process is carried on.
- Not acting on committee recommendations within 15 days.
