The Consumer Protection (E-Commerce) (Amendment) Rules, 2026 were notified as G.S.R. 789(E) on 9 September 2026 and apply only from 1 January 2027. Today, 3 October 2026, the E-Commerce Rules, 2020 apply without these changes. This article lists every change paragraph by paragraph so that platforms and sellers can prepare in time.

The principal rules are the E-Commerce Rules, 2020 (G.S.R. 462(E) of 23 July 2020), taken here as amended up to the Consumer Protection (E-Commerce) (Amendment) Rules, 2026 (G.S.R. 789(E) of 9 September 2026, in force from 1 January 2027). Later amendments should be checked on the website of the Department of Consumer Affairs.

Paragraph 1: title and commencement

The rules may be called the Consumer Protection (E-Commerce) (Amendment) Rules, 2026 and "shall come into force with effect from 1st January, 2027". The notification is dated New Delhi, 9 September 2026, from the Department of Consumer Affairs, Ministry of Consumer Affairs, Food and Public Distribution. The principal rules were published as G.S.R. 462(E) on 23 July 2020. Platforms that want a plan for the transition can ask for a compliance advisory review.

Until 31 December 2026 the rules apply as amended by G.S.R. 328(E) of 17 May 2021 (which substituted rule 4(1), the nodal officer rule) and read with the corrigendum G.S.R. 488(E) of 4 August 2020 (under which clause letters printed in Devanagari in rule 4(2)(a)-(d) and rule 5(3)(e)-(f) read as (a) to (f)).

Paragraph 2: rule 3(1)(j), "ranking"

Clause (j) is substituted so that ranking means "the relative prominence or relevance given to the sellers on the platform or to the goods or services" offered through a marketplace. See rule 3.

Paragraph 3: rule 4

  • Rule 4(2) substituted: information displayed "at an appropriate place"; "fax" is no longer listed among customer care and grievance officer contact details. See rule 4(1)-(3).
  • Rule 4(5) substituted: the grievance officer acknowledges within forty-eight hours, "provides the complainant with a copy of the complaint as recorded by the grievance officer" and redresses within one month.
  • Rule 4(6) substituted: importer details continue, and the entity must also provide for identification of goods and mention the full and complete name of the country of origin of goods imported into India, as provided under the Legal Metrology (Packaged Commodities) Rules, 2011.
  • Rule 4(7) substituted: "Every e-commerce entity shall become a partner in the convergence process of the National Consumer Helpline."
  • Rule 4(11)(c) inserted: no entity shall "mislead users by manipulating search result or search indexes having regard to the search query of the user".
  • Rule 4(12) to (15) inserted: sponsored listings distinctly identified; prior price shown with any announced price reduction ("prior price" means the lowest price of a good or service thirty days prior to the announcement); the seller's name on the invoice in the same font size as the entity's name; compliance with the Guidelines for Prevention and Regulation of Dark Patterns, 2023 and a yearly self-audit, with a certificate displayed prominently.

The sub-rules are explained in rule 4(4)-(7) and rule 4(8)-(11). The dark pattern guidelines are in our articles on guidelines 1 to 7, items 1 to 4, items 5 to 8 and items 9 to 13.

Paragraph 4: rule 5

  • Rule 5(3)(a) substituted: seller details now include "name and details of its website and email address, where available".
  • Rule 5(3)(c) substituted: adds the use-before date (the rule names both date labels), with a proviso that for food products the display is subject to the Food Safety and Standards Act, 2006 and its regulations.
  • Rule 5(3)(f) substituted: the main ranking parameters are explained "in descending order".
  • Rule 5(6) inserted: no use of collected information for same-brand sales or to promote associated sellers without the express and affirmative consent of the consumers concerned.
  • Rule 5(7) inserted: no bundled fees for unrelated services; loyalty and membership programmes are excepted.

See rule 5(3) and rule 5(1), (2), (4), (5).

Paragraph 5: rule 6

  • Rule 6(5)(d) substituted: a fuller list of details including country of origin, the use-before date, return, refund, exchange, warranty and guarantee, delivery and shipment, cost of return shipping and modes of payment, with the food proviso.
  • Rule 6(5)(j) inserted: "any identification number issued by the Central Government including Goods and Services Tax Identification Number or Micro and Small Medium Enterprises registration number".

See rule 6(4) and (5).

Paragraph 6: rule 7

  • Rule 7(1)(a) substituted: adds the use-before date to the information inventory entities must give, with the food proviso. See rules 7 and 8.

What to change before 1 January 2027

  1. Re-check the contact block: landline and mobile numbers, at an appropriate place.
  2. Make the complaint system send a copy of the complaint as recorded (the rule prints no separate time for the copy).
  3. Add country of origin and importer details for imported goods.
  4. Treat National Consumer Helpline partnership as a duty.
  5. Label sponsored listings; show the prior price with any announced reduction; put the seller's name on invoices in the same font size.
  6. Plan the yearly dark pattern self-audit and the certificate.
  7. Marketplaces: update seller display pages, the ranking explanation and the consent flow for collected information.
  8. Sellers: supply a Central Government identification number such as GSTIN or MSME registration number.

The amendment prints no penalty; a contravention of the rules is dealt with under the Act (rule 8). For the Act see section 94 and our existing overview of the E-Commerce Consumer Protection Rules 2020.
