Overview

Gujarat charges stamp duty on property transfers based on the state\'s jantri (Annual Statement of Rates) or the actual consideration, whichever is higher. The headline rate is presented as a basic duty plus a surcharge, and the state offers a registration-fee waiver for women buyers.

Applicable Law and Authority

The charging statute is the Gujarat Stamp Act, 1958, and registration is under the Registration Act, 1908. The Superintendent of Stamps / Inspector General of Registration, Gujarat administers Sub-Registrar offices, and the Garvi portal handles valuation, duty calculation and registration workflow.

How Duty Is Computed — Worked Example

Take a flat with a jantri value of ₹45,00,000 and a sale price of ₹48,00,000. Duty is charged on ₹48,00,000. At an effective 4.9%, stamp duty is about ₹2,35,200. For a general buyer, add a 1% registration fee of ₹48,000, for a total of about ₹2,83,200. If the flat is registered in a woman\'s sole name, the registration fee is waived and the cost is roughly ₹2,35,200.

Process and Documents

Check jantri value on Garvi, prepare the deed, pay stamp duty (and registration fee if applicable), book a Sub-Registrar slot, and register with parties and witnesses. Typical documents: draft deed, PAN and Aadhaar, jantri/valuation proof, prior title deeds, index and 7/12 or city survey extract, and payment challans.

Due Dates and Penalties

Stamp the instrument before execution and register within four months (extendable by four months with a fine) under the Registration Act. Under-stamping attracts penalty on impounding, and an under-stamped or unregistered compulsorily registrable document is inadmissible until regularised.
