Rules 12 explained: this guide covers what it means, who it applies to, the step-by-step process, documents required, fees, due dates and penalties in India — so you can stay compliant with confidence and avoid costly mistakes.
Rule 12 names who enforces the Plastic Waste Management Rules, and since the 2026 amendment it puts the local body, the Gram Panchayat and the district-level Panchayat on that list. Rule 13 lays down registration for producers, importers, brand owners, recyclers, processors and raw material makers and sellers. Rule 14 puts a duty on retailers and street vendors. Rule 15 was omitted in 2018.
These Rules are current as amended up to the Plastic Waste Management (Amendment) Rules, 2026 (G.S.R. 237(E), 31 March 2026). Later amendments, CPCB guidelines and notifications should be checked. The CPCB, State Boards and Committees enforce the Rules (rule 12(1)), together with the municipal and Panchayati Raj departments (12(2) and (3)) and, from 31 March 2026, the local body, Gram Panchayat and district-level Panchayat within their jurisdictions (12(3A) to (3C)). Producers, importers and brand owners register once, through the centralised online portal, with the CPCB if they operate in more than two States or Union territories (rule 13). Registration is deemed if none is granted within thirty days of a complete application (13(8)).

Sub-rule (3A) also settles overlap: where an urban local body and a local authority constituted under relevant statutes have overlapping jurisdictions, the urban local body is the enforcement authority, and in areas beyond the urban local body's jurisdiction but within the jurisdiction of the local authority, including peri-urban areas, the local authority is the enforcement authority. This adds the local tier to the list of enforcers, and it should be read with the local body's duties in rules 5 to 7A.
Rule 13: registration
Who registers where (13(1) and 13(2))
No person shall manufacture carry bags or recycle plastic bags or multilayered packaging unless registered with the State Pollution Control Board or Pollution Control Committee, if operating in one or two States or Union territories, or with the Central Pollution Control Board, if operating in more than two States or Union territories (13(1)).
Every producer, importer or brand owner shall, for the purpose of one-time registration, apply in Form I through the centralised online portal specified in Schedule II, to the same two authorities by the same test (13(2)). The words "or for renewal of registration" were removed from sub-rule (2) in 2023, in line with the move to one-time registration.
Recyclers and processors (13(3), 13(5), 13(7))
Every person recycling or processing, or proposing to recycle or process, plastic waste applies for one-time registration to the State Board or Committee in Form II through the centralised portal (13(3)). The Board shall not grant registration to a recycling or processing unit unless it has valid consent under the Water Act, 1974 and the Air Act, 1981 and a registration certificate from the District Industries Centre or another authorised Government agency (13(5)). On a complete application the Board may, after such inquiry as it considers necessary and on being satisfied that the applicant has facilities, technical capability and equipment to handle plastic waste safely, grant registration on the conditions it lays down, and the registration is subject to fulfilment of the EPR obligations in Schedule II (13(7)). Raw material manufacturers, importers and sellers (13(4), 13(4A), 13(4B))
- Every manufacturer and importer of plastic raw material applies to the State Board or Committee for registration in Form III (13(4)).
- Such a manufacturer or importer shall sell plastic raw material only to a registered producer or seller, with the buyer's registration number on the sale invoice; shall not sell to entities making prohibited single use plastic items; shall print on all raw material packaging bags a statement that the material is "Not to be used in the manufacture of single use plastic items prohibited under the Plastic Waste Management Rules, 2016 including plastic sheets < 50 micron thickness, non-woven carry bags < 60 GSM, Carry bags < 120 micron thickness"; and shall submit a quarterly report to the CPCB and the State Board or Committee (13(4A)).
- Every person selling plastic raw material or intermediate material to producers applies to the State Board or Committee for registration (13(4B)).
Time limit and fairness (13(8) and 13(10))
Where registration is not granted within thirty days after the receipt of an application complete in all respects, the applicant is deemed registered on the expiry of that period (13(8)). The Board shall not revoke, suspend or cancel a registration without giving the producer or recycler an opportunity of a hearing (13(10)).
What is gone
Sub-rule (6), on renewal only against an action plan endorsed by the urban development secretary, was omitted in 2022 (G.S.R. 522(E)); sub-rules (9) and (11) were omitted in 2023 (G.S.R. 807(E)).
Forms
Form I is the producer, brand owner and importer application, Form II the recycler and processor application, and Form III the application of raw material manufacturers and importers. The Rules also print forms for annual and quarterly reports, which are covered with the reporting rules.
Rule 14: retailers and street vendors
Retailers and street vendors shall not sell or provide commodities to consumers in carry bags, plastic sheets or multilayered packaging that are not manufactured and labelled or marked as the Rules prescribe (14(1)). A retailer or street vendor who sells or provides commodities in plastic carry bags, multilayered packaging, plastic sheets or like or covers made of plastic sheets that are not manufactured or labelled or marked as the Rules require is liable to pay the fine specified under the bye-laws of the local bodies (14(2)). The Rules print no amount; the local body's bye-laws do.
Rule 15: omitted
Rule 15 was omitted by the Plastic Waste Management (Amendment) Rules, 2018 (G.S.R. 285(E)).
Who is affected
Producers, importers, brand owners, recyclers, processors, raw material manufacturers, importers and sellers, retailers and street vendors, State and Union territory governments and every local body or panchayat that now enforces the Rules. A retailer's exposure comes from rule 14 and the local body's bye-laws; the packaging the retailer sells must carry the labels required by rule 11.
Example
Kiran Polymers Private Limited sells polyethylene resin to converters in three States. It registers in Form III with the State Board of its home State, not the CPCB, because rule 13(4) says the application goes to the State Board or Committee. Each invoice carries the buyer's registration number, each resin bag carries the required statement, and the company files its quarterly report with the CPCB and the State Board. A converter without a registration number is not supplied, because rule 13(4A)(i) allows sale only to a registered producer or seller.
