Rule 1.1.1 of the Food Safety and Standards Rules, 2011 gives the rules their name. Rule 1.2.1 defines thirteen terms used throughout the rules, from "Act" and "Adjudicating Officer" to "Licensing Authority", "Notified laboratory", "Referral laboratory" and "Registrar". Each definition is tied to a section of the Food Safety and Standards Act, 2006, so the list works as a bridge between the two texts. Rule 1.1.1: "These rules may be called the Food Safety and Standards Rules, 2011." Rule 1.1.1: the short title
The rules may be called the Food Safety and Standards Rules, 2011. In the compendium the rule is a single sentence. The rules are made under section 91 of the Act, which lets the Central Government make rules by notification (see Central Government rule-making under section 91). Rule 1.2.1: the definitions, grouped
The definitions begin "In these rules, unless the context otherwise requires". They fall into four groups.
The Act and the Rules
- "Act" is the Food Safety and Standards Act, 2006 (Act 34 of 2006).
- "Rules" means the Food Safety and Standards Rules, 2011.
Adjudication and appeal
- "Adjudicating Officer" is the officer appointed under section 68(1). The Act says the State Government notifies an officer not below the rank of Additional District Magistrate (see adjudication of food safety cases).
- "Inquiry" is "the inquiry referred to in section 68", the hearing at which the person gets a reasonable opportunity to make representation.
- "Appellate Tribunal" is the Food Safety Appellate Tribunal constituted under section 70 (see appeal to the Tribunal).
- "Presiding Officer" is the person appointed to head the Tribunal under section 70.
- "Registrar" and "Registry" belong to the Tribunal: the Registrar includes an officer authorised by the Presiding Officer to function as Registrar, and the Registry is the Tribunal's registry.
- "Advocate" is a person entitled to practise law under the Advocates Act, 1961. A party can be represented by an advocate in the proceedings the Rules describe.
Enforcement and licensing
- "Licensing Authority" means "the Designated Officer appointed under section 36 of the Act for the local area and includes any other officer so appointed for the purpose of granting license by the Commissioner of Food Safety". For a food business, this is the officer who processes a State licence application. - "Authorised Officer" is an officer authorised by the Food Authority under section 47(5). Section 47 deals with the sampling and analysis procedure.
Laboratories
- "Notified laboratory" means any laboratory notified by the Food Authority under section 43(1) and (2).
- "Referral laboratory" means a laboratory established or recognised by the Food Authority by notification under section 43(2).
The two terms are used separately in the Rules' sample-analysis provisions, so check which one a provision names (see recognition of laboratories and food safety audit agencies). The exact steps are in Chapter 2 of the Rules, which later articles in this series cover.
Why the definitions matter in practice
Many disputes turn on who did what. If a notice comes from someone who is not the Designated Officer or Licensing Authority, or a sample is analysed at a laboratory that is not notified, the food business can ask whether the procedure was followed. A reading of the definitions helps:
- Identify the officer. Is the sender the Licensing Authority, the Designated Officer, an Authorised Officer or the Adjudicating Officer?
- Identify the laboratory. Was it a notified laboratory or a referral laboratory?
- Identify the forum. Is the matter before the Adjudicating Officer (inquiry) or the Appellate Tribunal?
- Identify the representative. An Advocate within the meaning of the Advocates Act can appear for you.
Example 1. A licence application is pending. The "Licensing Authority" for the local area is the Designated Officer under section 36, or another officer appointed by the Commissioner for granting licences. The application goes to that authority.
Example 2. A food sample is tested and the result is disputed. The business checks that the laboratory is a notified laboratory under section 43 and asks whether the matter can go to a referral laboratory.
