Regulations 4 to 7 of the Customs (Voluntary Revision of Entries Post Clearance) Regulations, 2025 describe how a revision actually happens: how the electronic application is made, when it is deemed made and self-assessed, how the proper officer verifies it, how long the papers are kept, and what penalty applies. They pick up where regulations 1 to 3 (the definitions and conditions) stop.

This article reads them as amended up to Notification No. 70/2025-Customs (N.T.) dated 30 October 2025, in force from 1 November 2025 (no amendment found up to 3 October 2026), together with the fee entry added to the Levy of Fees regulations by Notification No. 69/2025-Customs (N.T.) dated 30 October 2025. This is the text as published, and later notifications should be checked.

Making the application (regulation 4)

Regulation 4(1) lets an importer or exporter, or the authorised person, make, subject to the regulation 3 conditions, either an electronic application for revision of entries or an application for revision of entries cum refund, as the case may be, with the supporting documents. The application is entered on the common portal with the digital signature of the person making it, so the portal access and signature must be in place first; our ICEGATE registration service covers that. "Digital signature" has the meaning in the Information Technology Act, 2000.

When the application is deemed made and self-assessed (regulation 4(2))

All three of these must be met, joined by "and":

  1. The entries are successfully accepted in the customs automated system and the Acknowledgement Receipt Number is generated by the common portal.
  2. Duty, if any is leviable, along with interest as applicable under section 28AA, is paid voluntarily on the common portal against the Acknowledgement Receipt Number.
  3. A Revised Entry Reference is generated by the customs automated system.

The practical consequence is that a revision is not complete merely because the data is accepted: the voluntary payment, where duty is leviable, is part of the trigger. The regulation does not state the interest rate or period; that comes from section 28AA of the Act.

Refund date (regulation 4, second numbered sub-regulation)

In the notification, the sub-regulation after (2) is numbered "(5)". It says that for an application for revision of entries cum refund, the date of generation of the Acknowledgement Receipt Number is deemed to be the date of claim for refund under section 27. The numbering jumps from (2) to (5) in the published text, so refer to it by its words. This matters because section 27 time limits and interest turn on the date of the claim.

Verification by the proper officer (regulation 5)

Sub-regulationWhat it provides
5(1)Revised entries and self-assessment are subject to verification by the proper officer in cases selected primarily on the basis of risk evaluation through appropriate selection criteria
5(2)The proper officer may require the authorised person to produce any document or information by which the duty leviable, or the nature of the revision, can be ascertained, and the authorised person must produce it
5(3)Where documents or information are required for verifying a revision cum refund application, they shall be sought within ten working days from the date of generation of the Revised Entry Reference
5(4)The proper officer verifies the refund application for completeness and, if complete in all respects, issues an acknowledgement in the prescribed Form under the Customs Refund Application (Form) Regulations, 1995 within ten working days of receipt. Explanation: for interest on delayed refunds under section 27A, the application is deemed received on the date a complete application, as acknowledged, was made, or the date of re-assessment under sub-regulation (5), whichever is later
5(5)If on verification the self-assessment is found incorrect, the proper officer may, without prejudice to other action, re-assess the duty by a speaking order following the principles of natural justice. Proviso: in a revision cum refund case where the officer is satisfied that duty or interest paid is refundable, he may order a refund in terms of section 27(2)
5(6)On completion of verification, by re-assessment or otherwise, the statement of revised entry is generated and made available electronically to the importer or exporter and transmitted to the other agencies to whom the entry was earlier transmitted

Example: Bhima Chemicals Private Limited files a revision cum refund application after finding that an item was classified under a wrong heading and duty was overpaid. The Revised Entry Reference is generated on a Monday. If the officer wants documents, he must ask within ten working days of that date. If the application is complete, he must issue the acknowledgement within ten working days of receiving it, and that acknowledgement fixes the date from which interest on a delayed refund is counted, subject to the Explanation above.

For the refund and interest provisions, see our articles on section 27 of the Customs Act and the refund grounds and claim process.

The fee

Regulation 3(c) requires the fee to be paid under the Levy of Fees regulations. Item (xi) of the Table in the Levy of Fees (Customs Documents) Regulations, 1970, inserted by Notification No. 69/2025-Customs (N.T.) dated 30 October 2025, lists "Electronic Application under Customs (Voluntary Revision of Entries Post Clearance) Regulations, 2025" at Rs. 1000.00. The full table is in our article on the Levy of Fees regulations. The fee is a document fee; it is separate from any duty and interest paid under regulation 4(2).

Retention of documents (regulation 6)

The authorised person retains, for five years from the date of revision of the entry, the electronic application, the certificate of revised entry and all supporting documents in original which were used or relied upon, and furnishes them to the proper officer in connection with any action or proceedings under the Act or any other law for the time being in force. Compare the import and export regulations, where the five years run from presentation: here they run from revision. Our article on the import-side declaration regulations explains that parallel rule.

Penalty (regulation 7)

The importer or exporter who contravenes any provision, or abets such contravention, is liable to a penalty specified under section 158(2)(ii) of the Act, without prejudice to any other action under the Act, rules, regulations or any other law. The regulation names the importer or exporter, not the customs broker. The amount is whatever that clause provides.
