Renew FCRA Registration Online explained: this guide covers what it means, who it applies to, the step-by-step process, documents required, fees, due dates and penalties in India — so you can stay compliant with confidence and avoid costly mistakes.
A certificate of registration under the Foreign Contribution (Regulation) Act, 2010 is valid for five years. Renewal is applied for in electronic form in Form FC-3C, with an affidavit from each key functionary in Proforma 'AA', within six months before the date of expiry, with a fee of rupees five thousand. This article sets out what section 16, rule 12 and the Form print, including what follows if the application or the fee is not received in time.
It is written as per the Foreign Contribution (Regulation) Act, 2010 read with the Amendment Act, 2020, and the Foreign Contribution (Regulation) Rules, 2011 as amended by the notifications named in this article (latest consulted: S.O. 3272(E) dated 22 June 2026). Later amendments, notifications and Ministry of Home Affairs orders should be checked. The Rules say "in electronic form" and name the Form; this article gives no screen-by-screen steps because the Rules and the Form print none. Our 12A, 80G and CSR registration team can help you plan the dates from your certificate.
Section 16(1): the certificate shall be renewed within six months before the expiry of its period. Rule 12(2): application in electronic form in Form FC-3C, with an affidavit by each key functionary in Proforma 'AA', within six months before the date of expiry (the corrigendum G.S.R. 17(E) changed "from" to "before"). An FCRA Account must be opened and mentioned (rule 12(2A)). Fee: rupees five thousand only (rule 12(4)). If no application or fee is received before expiry, the certificate is deemed to have ceased, and no foreign contribution may be received or utilised until renewal (rule 12(5), (6)).
What the Act says: section 16
Section 16(1) requires every person granted a certificate under section 12 to have it renewed within six months before the expiry of the period of the certificate. The Amendment Act, 2020 added a proviso: before renewing, the Central Government may make such inquiry as it deems fit to satisfy itself that the person has fulfilled all the conditions in section 12(4). Section 16(2) leaves the form, manner and fee to the Rules. Under section 16(3) the Central Government shall renew the certificate, ordinarily within ninety days of receipt of the application, subject to terms and conditions it deems fit, for a period of five years. If it does not renew within ninety days, it communicates the reasons; and it may refuse to renew where a person has violated the Act or the Rules. See section 16 and the five-year validity in rule 10(1), explained in rules 10 and 11. The Act and the Rules print no other processing time.
What rule 12 requires
| Sub-rule | Requirement as printed |
|---|---|
| (1) | A certificate is liable to be renewed after the expiry of five years from the date of its issue on proper application |
| (2) | Application to the Central Government in electronic form in Form FC-3C, with an affidavit executed by each key functionary in Proforma 'AA', within six months before the date of expiry of the certificate |
| (2A), (2B) | The person shall open an FCRA Account and mention its details in the application; pending applications were considered after the details were furnished |
| (4) | Fee of rupees five thousand only, paid through the payment gateway specified by the Central Government |
| (5) | No person whose certificate has ceased to exist shall receive or utilise foreign contribution until the certificate is renewed |
| (6) | If no application is received, or it does not carry the fee, before expiry, the validity is deemed to have ceased on completion of five years from the date of the grant |
| (6A) | Unutilised foreign contribution in the FCRA Account and utilisation account, and assets created from it, vest with the prescribed authority until renewal or fresh registration |
| (7), (8) | A fresh request under rule 9 may be made; in a case of sufficient grounds in writing, a late application may be considered with the fee and a late fee of Rs.5000/-, not later than one year after expiry |
Sub-rules (1), (7) and (8) rest only on the third-party consolidation of 17 September 2019; confirm them, including the late fee and the one-year limit, against the official text. Rule 12(2), as first printed in G.S.R. 695(E) of 10 November 2020, said "from the date of expiry"; the corrigendum G.S.R. 17(E) of 11 January 2021 substituted "before", which matches section 16(1). The 2026 notification replaced "each office bearer, key functionary and member" with "each key functionary". Rule 12(6) carries its own illustration: a certificate granted on 1 January 2012 is valid till 31 December 2016, and the request for renewal is submitted after 30 June 2016 and within 31 December 2016. See rule 12.
"Reasonable activity" and renewal
Rule 14A, inserted by S.O. 3272(E), says that for the purposes of cancellation under section 14 and renewal under section 16 an association is deemed to have undertaken reasonable activity in its chosen field for the benefit of society if it has utilised foreign contribution of not less than ten lakh rupees in the last two financial years for that purpose. The Explanation limits "reasonable activity" to activity undertaken out of, or by utilising, foreign contribution received in accordance with the Act. See rules 14 and 14A.
What Form FC-3C contains
The Form is marked "(See sub-rule (2) of rule 12)" and is addressed to the Secretary, Ministry of Home Affairs, Foreigners Division (FCRA Wing). Its parts are:
- applicant details, the Act of registration, the FCRA registration number and date, and foreign contribution received in each of the last three financial years;
- the nature, main aims and objects, and details of key functionaries, including those changed since the original application;
- the fee paid, and disclosures on convictions, prosecutions, diversion of funds, prohibition, earlier suspension, cancellation or refusal of renewal, and close links with other bodies;
- details of the FCRA Account (any change in bank details is to be intimated in Form FC-6C) and of all utilisation bank accounts;
- from 2026, whether the body was constituted under a Central or State Act or order, is wholly owned by a Government, or is audited by the Comptroller and Auditor General.
The 2025 Note requires an affidavit in Proforma 'AA' for each person in the key functionaries table and, where registration has ceased, an affidavit on receipt and utilisation of foreign contribution after expiry with certified bank statements from expiry. The 2026 notification added to the Note a year-wise detailed activity report of the last three financial years. The Forms are described in the Forms article.
Who signs
The chief functionary (Chairperson, President, Secretary, CEO or MD) signs in block letters with the seal on the application and the Declaration and Undertaking. The declaration says the information is true and correct, that receipt and utilisation shall not violate the Act, Rules, notifications or orders, and that the office bearers and key functionaries and members meet the section 12(4) criteria. The Form's declaration still uses "office bearers and key functionaries and members", while rule 12(2) now speaks of "each key functionary"; both are stated as printed. Section 12A allows the Central Government to require identification of key functionaries with a renewal application; see section 12A. Proforma 'AA' affidavits can be prepared with our affidavit and declaration drafting service.
