Rajasthan Wage explained: this guide covers what it means, who it applies to, the step-by-step process, documents required, fees, due dates and penalties in India — so you can stay compliant with confidence and avoid costly mistakes.
Chapter III of the Rajasthan wage rules (rules 12 to 19) controls what an employer may take out of wages, how a fine is approved, how deductions are reported and how advances are recovered. A payroll team that deducts without following these steps risks a dispute with the Inspector-cum-Facilitator.
Total authorised deductions beyond fifty percent of wages in a wage period are carried forward, so recovery in any month never exceeds fifty percent (rule 12). A fine needs approval of the notified Authority, who must decide within 30 days or the fine is deemed approved (rule 15). A deduction under the proviso to section 20(2) must be intimated to the Inspector-cum-Facilitator within 10 days (rule 16).

These are the Code on Wages (Rajasthan) Rules, 2026, as notified by S.O.40 dated 12 August 2026 in the Rajasthan Gazette Extraordinary of the same date. Later amendments and State notifications under these rules should be checked in the State Gazette. Under rule 1(3) they come into force "on the date of their publication in the Official Gazette". The Central rules on the same subject are explained in recovery of deductions and procedure for fines; this article covers what Rajasthan prints.

Fifty percent ceiling (rule 12)
Where the deductions authorised under section 18(2) of the Code exceed fifty percent of an employee's wages, rule 12 requires the excess to be carried forward and recovered from succeeding wage periods in installments, so that the recovery in any month does not exceed fifty percent of that month's wages. Plan loan and other recoveries so that the sum in a month stays within the ceiling.
Fines: authority, notice and approval (rules 13 to 15)
Rule 13 makes the authority notified by the State Government, having jurisdiction over the employee's place of work, the authority for section 19(1). Rule 14 requires the section 19(2) notice to be displayed in physical form or electronically in Hindi, English and the local language at conspicuous places in the premises, so that every concerned employee can read it easily, and a copy to be sent electronically or by registered post to the Inspector-cum-Facilitator with jurisdiction.
Under rule 15, an employer who wants approval of a fine gives an intimation, electronically or in writing, with detailed particulars to that Authority. The Authority must give the employee and the employer an opportunity of being heard and dispose of the matter within 30 days from receiving the intimation, "failing which, it shall be deemed to be approved". Fines are recorded in Form-I (rule 42(2)). The Central position is explained in the Central rules on fines.
Intimation of a deduction (rule 16)
Where an employer makes a deduction under the proviso to section 20(2), rule 16(1) requires intimation, electronically or by registered post, to the Inspector-cum-Facilitator within 10 days of the deduction, explaining the reason. Under rule 16(2) the Inspector-cum-Facilitator examines the explanation and, if it contravenes the Code or the rules, initiates appropriate action against the employer within 30 days from receipt of the intimation.
Deduction for damage or loss (rule 17)
Before deducting for damage or loss under section 21, the employer must:
- explain to the employee personally and in writing the damage or loss of goods expressly entrusted for custody, or the loss of money for which the employee is required to account;
- explain how the damage or loss is directly attributable to the employee's neglect or default;
- give the employee an opportunity to submit an explanation; and
- intimate any deduction made to the employee within fifteen days of the deduction.

Advances and loans (rules 18 and 19)
Rule 18 covers recovery of advances of money given after employment begins (section 23(b)) and advances of wages not yet earned (section 23(c)). Recovery is made in installments determined by the employer, but all installments in a wage period may not exceed fifty percent of the employee's wages, subject to the ceiling in rule 12, and the particulars are recorded in the register in Form-I. Rule 19 says deductions to recover house-building or other approved loans, with interest, are subject to any direction or circular the State Government issues on the extent of the loans and the rate of interest.
A worked example
Gupta Auto Components of Alwar proposes a fine on a press operator, Sunita, for a safety lapse. Its HR manager sends an intimation with full particulars to the notified Authority, displays the notice of fines in Hindi, English and the local language, and copies it to the Inspector-cum-Facilitator. The Authority hears both sides. If no decision is made within 30 days of receiving the intimation, the fine is deemed approved under rule 15. The company records the fine in Form-I and does not deduct more than fifty percent of the month's wages.
Common lapses
- Deducting a fine before the Authority has approved it or the 30 days have passed.
- Forgetting to send the rule 14 notice copy to the Inspector-cum-Facilitator.
- Not intimating a section 20(2) proviso deduction within 10 days.
- Failing to tell the employee about a damage or loss deduction within fifteen days.
- Recovering an advance in one installment that takes the month past fifty percent.
