Arunachal Pradesh explained: this guide covers what it means, who it applies to, the step-by-step process, documents required, fees, due dates and penalties in India — so you can stay compliant with confidence and avoid costly mistakes.
Chapters III to VI of the Code on Social Security (Arunachal Pradesh) Rules, 2021 tell an employer how to handle a gratuity nomination and claim, a maternity benefit complaint, an employee's compensation case and proceedings before the Employees Insurance Court. This article takes each in turn, with the periods, forms and sums exactly as printed.
A gratuity nomination is made in Form XIV and the employer verifies and returns it within thirty days (rule 59). A gratuity application is ordinarily made within thirty days in Form XV, and the employer issues a Form XVI notice within fifteen days, fixing payment not later than the thirtieth day after receiving the application (rule 60). On a death caused by injury, the employer deposits not less than Rs.15000 for funeral expenses with the Competent Authority (rule 64). An Employees Insurance Court appeal is filed in Form III within 90 days (rule 24).
Which rule set this is
The Code on Social Security (Arunachal Pradesh) Rules, 2021, as notified on 17 December 2021 in the Arunachal Pradesh Gazette Extraordinary No. 285 of 23 December 2021. Rule 1(3): "These rules shall come into force from the date of effect of the Code on Social Security, 2020." The four Labour Codes were brought into force from 21 November 2025. Later amendments and State notifications under these rules should be checked in the State Gazette. Boards, cess and vacancy reporting are in our sibling article on boards, cess, authorities and vacancy reporting.

Gratuity (Chapter IV, rules 58 to 62)
The Central position is covered in our posts on gratuity for minors and nomination and on application for gratuity and appeal. The Arunachal Pradesh text prints these steps.
Nomination (rule 59). The employee submits a nomination in Form XIV, in duplicate, by personal service with a receipt, by registered post acknowledgement due, or electronically.
| Case | Rule | Time as printed |
|---|---|---|
| Employee already in employment for a year or more when the rules began, no nomination yet | 59(1)(a) | Ordinarily within ninety days |
| Employee completing one year of service after the rules began | 59(1)(b) | Ordinarily within thirty days of completion |
| Employee with no family at the time of nomination, who later acquires one | 59(3) | Fresh nomination within ninety days of acquiring a family |
| Employer's verification and return of the duplicate | 59(2) | Within thirty days of receipt, after verifying service particulars |
A late nomination is accepted, and "no nomination so accepted shall be invalid merely because it was filed after the specified period". A nomination takes effect from the date the employer receives it (rule 59(6)). A modification, including where a nominee predeceases the employee, is a notice in duplicate in Form XIV.
Application and notice (rule 60).
- The employee, or a person authorised in writing, applies in Form XV to the employer, ordinarily within thirty days from the date gratuity became payable. If the retirement date is known, the employee may apply before thirty days of that date. A nominee also applies within thirty days (plain paper is accepted); a legal heir ordinarily within one year.
- Within fifteen days of receiving the application the employer issues a notice in Form XVI. If the claim is admissible, the notice states the amount and a payment date "not being later than the thirtieth day after the date of receipt of the application". If it is not admissible, the notice gives reasons and a copy is endorsed to the Competent Authority.
- Gratuity is paid by demand draft or by credit to the bank account, with details of payment intimated to the Competent Authority of the area.
- A claimant refused a nomination or application, given a lower amount, or not given a notice in time may apply in Form XVII to the Competent Authority within one hundred eighty days of the cause, with extra copies for each opposite party.
- The Competent Authority calls both sides by Form XVIII, records a finding, and issues a Form XIX notice directing the employer to pay within thirty days of receipt. After an appeal decision, a modified Form XIX gives fifteen days.
- An appeal under section 56(8) is submitted to the Appellate Authority with a copy to the opposite party and the Competent Authority; the opposite party sends its comments within fourteen days.
- Where an employer does not pay as directed, recovery is sought in Form XX under section 129.
Fixed term employees. The second proviso to rule 60(1)(a) states that an employee on fixed term employment is eligible for gratuity if he renders service under the contract for a period of one year, and is paid at the rate of fifteen days' wages, based on the rate of wages last drawn, for every completed year of service or part thereof in excess of six months.
Minor beneficiary (rule 58). Gratuity for a minor nominee or heir is invested in a term deposit with the State Bank of India or a Nationalized Bank.
Insurance and registration (rule 61). An employer other than a Central or State Government establishment must, subject to section 57(1)(i), obtain insurance for its gratuity liability from an insurer regulated under the IRDA Act, 1999. Every employer of a covered establishment registers it with the Competent Authority of the area in Form XXI "within 30 days from the notification of the compulsory insurance" under section 57(1), with employee details in Form XXII. The certificate is issued immediately and not later than seven days from a complete application, failing which the establishment "shall be deemed to have been registered". An employer with an Approved Gratuity Fund who wishes to continue it, and an employer employing 500 or more persons who sets up one, submits an option in Form XXIII, provided the fund covers the entire liability. The Competent Authority is a Government officer not below the rank of Labour Officer (rule 62).
Maternity benefit (Chapter V, rule 63)
The rules deal only with complaint and appeal. A complaint under section 72 is made in writing in Form XXIV. The Inspector-cum-Facilitator examines the employer's records, takes statements from persons employed, and if satisfied that the benefit has been improperly withheld, directs the employer to pay the woman or the claimant "immediately or within a specified period". An appeal against that decision lies to the Competent Authority, in writing in Form XXV with supporting documents "within stipulated period"; the rules print no number of days. The Competent Authority calls for the record, may take statements and gives a decision. The rules print no nursing break or creche provision; for those see our Central post on nursing breaks and creche, and for the Central complaint route see competent authority and maternity benefit claims.
Employees' compensation (Chapter VI, rules 64 to 73)
| Obligation | Rule | As printed |
|---|---|---|
| Funeral expenses on death | 64(1) | In addition to compensation, deposit with the Competent Authority "a sum of not less than Rs.15000/- (Rupees Fifteen Thousand) only or such amount as may be notified by the State Government, from time to time", for the eldest surviving dependent or the person who actually incurred the expenditure |
| Central enhancement | 64(2) | If the Central Government enhances the amount, the State complies with it |
| Review without medical certificate | 65 | Allowed on grounds listed in rule 65(1): wages increased or diminished since the determination, payment stopped without change in condition, fraud or undue influence, or mistake apparent on the record |
| Notice Book | 66 | Every employer of an establishment dealing with hazardous work maintains a Notice Book in Form XXVI at the premises |
| Medical examination | 67 | Offered by the employer through a qualified medical practitioner, at the employee's residence or elsewhere in the vicinity |
| Statement by the employer | 68 | Within 30 days from receiving notice from the Competent Authority, in Form XXVII |
| Memorandum of agreement | 69 | Substantially in Form XXVIII (A), (B) or (C); notices in Forms XXIX, XXX and XXXI (A) and (B); register in Form XXXII (rule 73) |
| Time limit for disposal | 72(1) | Not more than six months from the date of application; where disability must be proved, extendable with the consent of both parties but not for more than one year |
| Certified copies | 72(2) | Rupees Ten only per page |
Medical examination rules include these limits: an employee should not be required to be examined at a place other than the place of residence more than twice in the first month after the accident, or more than once in any later month (rule 67(4)); the time specified for examination should not, without the employee's consent, fall between 7 P.M. and 6 A.M. (rule 67(3)); and a woman is not to be examined by a male practitioner without her consent except in the presence of another woman (rule 67(6)). Our Central posts on interest, notice and claim for compensation and on the compensation forms cover the Central side.
The Employees Insurance Court (Chapter III, rules 23 to 57)
The Government may appoint the Presiding Officer of the State Industrial Tribunal as the Employees Insurance Court (rule 23). The key points for an employer are these.
- Second appeal (rule 24). The insured person or the Corporation applies in Form III "within 90 days of the date of communication of decision of the Medical Board or of the Medical Appeal Tribunal"; the Court may entertain a later application for sufficient reason.
- Application (rule 25). Proceedings begin by an application in Form IV, verified as a civil pleading and accompanied by two copies; the Court may summarily reject a defective application.
- Documents and register (rules 26 and 27). Documents are listed as in Form V; applications are entered in a Register of Proceedings in Form VI.
- Fees (rule 55). Rs.200 on an application in a matter under section 49 and on any other application except a written statement the Court calls for; Rupees Ten only per page for copies; Rupees Ten only for an authorisation to appear and for filing a certified copy. Fees are paid by court fee stamps. A person who is extremely poor may be allowed to proceed without or on part payment (rule 57).
The rules also set out procedure on summons, written statements, issues, evidence, adjournments, orders, costs, decrees and execution (rules 28 to 54), which follow civil court practice. See our Central post on Employees Insurance Court proceedings.
A worked example
Subansiri Timber, an invented employer in Ziro, receives a gratuity application in Form XV from a retiring clerk on 1 of the month. It must issue a Form XVI notice within fifteen days of receiving the application and fix a payment date not later than the thirtieth day after receipt. If the clerk disputes the amount, the clerk has one hundred eighty days to approach the Competent Authority in Form XVII.
Common lapses
- Not verifying the Form XIV nomination and returning the attested duplicate within thirty days.
- Issuing no Form XVI notice, or issuing it late.
- Rejecting a nomination because it was filed late.
- Not keeping the Form XXVI Notice Book in a hazardous establishment.
- Depositing less than the printed funeral sum after a fatal injury.
