FSSAI Registration and Licence Fees in India

Schedule 3 to the Food Safety and Standards (Licensing and Registration of Food Businesses) Regulations, 2011 fixes the fee per annum: ₹100 for registration, ₹2,000 to ₹5,000 for a State licence depending on the category, and ₹7,500 for a licence issued by the Central Licensing Authority. The 2026 amendments did not change Schedule 3.

Registration and Licence Fee per Annum

Schedule 3 is headed "Fee for grant / renewal of license" and "Registration / license fee per annum in rupees". An application for registration in Form A (regulation 2.1.1) and an application for a licence in Form B (regulation 2.1.3) is filed with the fee given in this Schedule.

A licence for a food business listed in Schedule 1 is granted by the Central Licensing Authority. A food business not covered by Schedule 1 is licensed by the State or Union territory Licensing Authority (regulation 2.1.2, clauses (3) and (4)).

Schedule 3 adds that the fees paid by any applicant for a licence shall not be refundable under any circumstances. MT is metric tonne and LPD is litres per day.

The operationalisation notice is an FSSAI direction issued ahead of the final regulations and the copy on file carries no date. The gazette text of regulation 2.1.9 in the compendium still reads "one year license fee". Confirm the modification fee shown on the FoSCoS portal before paying.

The Food Safety and Standards (Licensing and Registration of Food Businesses) Amendment Regulations, 2026 (notification dated 10 March 2026, in force from publication in the Gazette of 11 March 2026) replaced regulation 2.1.7. The table compares the two texts.

New regulation 2.1.7(2) refers to the annual licence fee or registration fee "as specified by the Food Authority". No order of the Food Authority specifying a different annual fee was found in the saved FSSAI texts, so the chart shows the Schedule 3 figures.

Late Fee and Penalty

Food business without a licence

A food business operator required to hold a licence who manufactures, sells, stores, distributes or imports food without one is punishable with imprisonment up to six months and a fine up to ₹5 lakh. The Jan Vishwas Act, 2023 replaces this with a penalty up to ₹10 lakh from a date to be notified. FSS Act 2006 · s.63

Annual fee not paid

If the annual licence or registration fee is not paid, or the return is not filed by the due date, the licence or registration is deemed suspended until the fee or return is filed with the due penalty. Any food business carried on meanwhile is non-compliant. Regulation 2.1.7(2), 2026

Late annual return

Every licensed manufacturer and importer files Form D-1 by 31 May each year. Delay beyond 31 May attracts a penalty of ₹100 per day. Regulation 2.1.13(3)

Other contraventions

A contravention of the Act, rules or regulations for which no separate penalty is provided is liable to a penalty up to ₹2 lakh. FSS Act 2006 · s.58

How to Apply and Pay

Regulation 2.1.7 as substituted by the Amendment Regulations, 2026 (Gazette of 11 March 2026) says a licence and registration certificate are valid and subsisting unless suspended, cancelled or surrendered. Earlier, the validity was 1 to 5 years as chosen by the food business operator.

That late fee was in the earlier regulation 2.1.7(4) for a renewal application filed late, and it did not apply to registration. The regulation substituted in March 2026 has no renewal clause: if the annual fee is not paid, the licence or registration is deemed suspended until the fee is paid with the due penalty.

Section 63 of the FSS Act provides imprisonment up to six months and a fine up to ₹5 lakh. The Jan Vishwas (Amendment of Provisions) Act, 2023 replaces this with a penalty up to ₹10 lakh from a date to be notified.

Regulation 2.1.13(3) levies ₹100 per day of delay beyond 31 May. The return in Form D-1 is filed by licensed manufacturers and importers for each class of food products handled in the previous financial year.

The Licensing Authority issues the licence within 60 days from the date of the application ID number (regulation 2.1.4(1)). If no licence is issued within 60 days of the complete application and no deficiency or inspection report is received, the applicant may start the business (regulation 2.1.6).

The Registering Authority grants or rejects the registration, or orders an inspection, within 7 days of the application. Where an inspection is ordered, registration is granted within 30 days (regulation 2.1.1(3) and (4)).

Regulation 2.1.9(1) as printed in the compendium asks for a fee equivalent to one year licence fee for a change that alters the licence certificate. The FSSAI operationalisation notice gives ₹1,000 with the difference in annual fee on upgradation instead. Check the amount on the FoSCoS portal.
