Rule 83 explained: this guide covers what it means, who it applies to, the step-by-step process, documents required, fees, due dates and penalties in India — so you can stay compliant with confidence and avoid costly mistakes.
Rule 83 of the Central Goods and Services Tax Rules, 2017 sets out how a person becomes a goods and services tax practitioner, how the enrolment ends, what the practitioner may do for a registered person and what the registered person must do in return. It has eleven sub-rules and uses FORM GST PCT-01 to FORM GST PCT-05.
This article follows the CGST Rules, 2017 as amended up to 31 October 2025 in the compilation consulted; notifications issued after that date should be checked.
A person applies in FORM GST PCT-01 for enrolment, and must be a citizen of India, of sound mind, not adjudicated insolvent and not convicted by a competent court, and must meet one of the qualification conditions in rule 83(1). The officer enrols the applicant and issues FORM GST PCT-02, or rejects the application. A registered person authorises or withdraws a practitioner in FORM GST PCT-05, and the practitioner may then do only the tasks listed in rule 83(8) and indicated in that authorisation.
The section behind the rule
Rule 83 is made for section 48 of the CGST Act, 2017, which provides for goods and services tax practitioners: see section 48 of the CGST Act: goods and services tax practitioners. Sub-rule (4) of the rule refers to disqualification "under section 48". This article does not repeat the section; it takes the rule sub-rule by sub-rule. If you want a practitioner to prepare and file your returns, our GST return filing service works through the authorisation in FORM GST PCT-05 described below.
Rule 83(1): who may apply
An application in FORM GST PCT-01 may be made electronically through the common portal, either directly or through a Facilitation Centre notified by the Commissioner, for enrolment as a goods and services tax practitioner. The applicant must be a person who:
- is a citizen of India;
- is a person of sound mind;
- is not adjudicated as insolvent; and
- has not been convicted by a competent court,
and who satisfies any one of these conditions:
- Clause (a): a retired officer of the Commercial Tax Department of any State Government or of the Central Board of Indirect Taxes and Customs, Department of Revenue, Government of India, who during service had worked in a post not lower than the rank of a Group-B gazetted officer for a period of not less than two years;
- Clause (b): enrolled as a sales tax practitioner or tax return preparer under the existing law for a period of not less than five years;
- Clause (c): has passed a graduate or postgraduate degree or its equivalent examination having a degree in Commerce, Law, Banking including Higher Auditing, or Business Administration or Business Management from any Indian University established by any law for the time being in force; or a degree examination of any Foreign University recognised by any Indian University as equivalent; or any other examination notified by the Government, on the recommendation of the Council, for this purpose; or the final examination of the Institute of Chartered Accountants of India, the Institute of Cost Accountants of India or the Institute of Company Secretaries of India.
The rule refers to "the existing law" in clause (b). Check the current law for the corresponding provision.
Rule 83(2): enrolment or rejection
On receipt of the application, the officer authorised in this behalf makes such enquiry as he considers necessary and either enrols the applicant and issues a certificate in FORM GST PCT-02, or rejects the application "where it is found that the applicant is not qualified to be enrolled". The rule prints no period for the decision.
Rule 83(3): validity and the examination provisos
The enrolment made under sub-rule (2) "shall be valid until it is cancelled". Two provisos qualify this:
- No enrolled practitioner is eligible to remain enrolled unless he passes such examination, conducted at such periods and by such authority, as may be notified by the Commissioner on the recommendations of the Council. The authority and periods are therefore left to notification, which must be checked. The examination itself is the subject of rule 83A.
- A person to whom clause (b) of sub-rule (1) applies is not eligible to remain enrolled unless he passes the said examination within thirty months from the appointed date. The footnote to the compilation records that "thirty months" was substituted for "eighteen months" by Notification No. 03/2019-Central Tax dated 29.01.2019, with effect from 01.02.2019.
Rule 83(4) and (5): misconduct and appeal
If a practitioner is found guilty of misconduct in connection with any proceedings under the Act, the authorised officer may issue a notice to show cause in FORM GST PCT-03, give a reasonable opportunity of being heard and, by order in FORM GST PCT-04, direct that he "shall henceforth be disqualified under section 48 to function as a goods and services tax practitioner". Under sub-rule (5), a person against whom such an order is made may, within thirty days from the date of issue of the order, appeal to the Commissioner. For the matching disqualification of an authorised representative, see section 116 of the CGST Act: authorised representative.
Rule 83(6) and (7): authorisation and confirmation
Under sub-rule (6), any registered person may, at his option, authorise a practitioner on the common portal in FORM GST PCT-05, or at any time withdraw the authorisation in FORM GST PCT-05. The practitioner is allowed to undertake the tasks indicated in the authorisation during the period of authorisation.
Under sub-rule (7), where a statement required to be furnished by a registered person has been furnished by the practitioner authorised by him, a confirmation is sought from the registered person over email or SMS, and the statement furnished by the practitioner is made available to the registered person on the common portal. The proviso adds that where the registered person fails to respond to the request for confirmation till the last date of furnishing of the statement, "it shall be deemed that he has confirmed the statement".
Rule 83(8): the activities a practitioner may undertake
A practitioner can undertake any or all of the following on behalf of a registered person, if so authorised by him:
| Clause | Activity |
|---|---|
| (a) | furnish the details of outward supplies |
| (b) | furnish monthly, quarterly, annual or final return |
| (c) | make deposit for credit into the electronic cash ledger |
| (d) | file a claim for refund |
| (e) | file an application for amendment or cancellation of registration |
| (f) | furnish information for generation of e-way bill |
| (g) | furnish details of challan in FORM GST ITC-04 |
| (h) | file an application for amendment or cancellation of enrolment under rule 58 |
| (i) | file an intimation to pay tax under the composition scheme or withdraw from the said scheme |
The footnotes record that sub-rule (8) was substituted by Notification No. 03/2019-Central Tax dated 29-01-2019 with effect from 01-02-2019, and that the words "and inward" after "outward" in clause (a) were omitted by Notification No. 19/2022-Central Tax dated 01.10.2022. The proviso requires more than the ordinary consent for the sensitive items: where an application relating to a claim for refund, or an application for amendment or cancellation of registration, or an intimation to pay tax under the composition scheme or to withdraw from it, has been submitted by the practitioner, a confirmation is sought from the registered person, the application is made available to the registered person on the common portal, and it "shall not be further proceeded with until the registered person gives his consent to the same". For rule 58, see rule 58: enrolment of transporters and warehouse keepers.
Rule 83(9) to (11): duties on both sides
- The registered person (sub-rule 9). Opting to furnish a return through a practitioner, he gives consent in FORM GST PCT-05 to a practitioner to prepare and furnish his return, and, before confirming submission of any statement prepared by the practitioner, ensures that the facts mentioned in the return are true and correct.
- The practitioner (sub-rule 10). He prepares the statements with due diligence and affixes his digital signature on them or electronically verifies using his credentials.
- Enrolment in another State (sub-rule 11). A practitioner enrolled in any other State or Union territory is treated as enrolled in the State or Union territory for the purposes specified in sub-rule (8).
Who does what, by when
| Who | What | Form | When | Sub-rule |
|---|---|---|---|---|
| Applicant | Applies for enrolment | FORM GST PCT-01 | No period printed | (1) |
| Authorised officer | Enrols and issues certificate, or rejects | FORM GST PCT-02 | No period printed | (2) |
| Authorised officer | Show cause notice for misconduct | FORM GST PCT-03 | Before an order is made | (4) |
| Authorised officer | Disqualification order | FORM GST PCT-04 | After a reasonable opportunity of being heard | (4) |
| Person disqualified | Appeal to the Commissioner | Not named | Within thirty days from the date of issue of the order | (5) |
| Registered person | Authorises or withdraws practitioner | FORM GST PCT-05 | At his option; withdrawal at any time | (6) |
| Registered person | Confirms statement furnished by practitioner | Over email or SMS | Deemed confirmed if no response by the last date of furnishing | (7) |
A worked example
Meera Rao, an invented chartered accountant who has passed the final examination of the Institute of Chartered Accountants of India, applies in FORM GST PCT-01 and is enrolled; the officer issues FORM GST PCT-02. Kalinga Plastics, an invented registered person, authorises her in FORM GST PCT-05 to furnish its returns and to file a refund claim. She prepares the return with due diligence and signs it digitally. Kalinga Plastics receives the confirmation request over email, checks that the facts in the return are true and correct, and confirms. For the refund claim, the application is made available to Kalinga Plastics and is not proceeded with until it gives its consent, as the proviso to rule 83(8) says.
Later Kalinga Plastics withdraws the authorisation in FORM GST PCT-05, which it may do at any time. The practitioner may no longer undertake tasks for it.
Points to watch
- One authorisation form. FORM GST PCT-05 is used to authorise and to withdraw.
- Deemed confirmation. Silence till the last date of furnishing is treated as confirmation of the statement under the proviso to sub-rule (7).
- Consent for refunds, amendments, cancellation and composition. The proviso to sub-rule (8) requires the registered person's consent before the application proceeds.
- Examination. The examination provisos in sub-rule (3) depend on a notification; check it.
- Appearance before authorities. Enrolment under rule 83 is a condition of appearing as a practitioner: see rule 84 in rules 83B and 84.
