NPO Registration (12A), 80G Approval & CSR-1 in brief

Who it applies to, what it costs, how long it takes and which law governs it — before the details.

332 + 354Two orders, one applicationRegistration under section 332 exempts the NGO’s own income; approval under section 354 lets donors claim the section 133 deduction. Most NGOs apply for both together in the same form.
Talk to an NGO Compliance Expert

From 1 April 2026 the Income-tax Act, 2025 replaced the 1961 Act, and what was called 12A / 80G registration has a new name and new numbers. A charitable trust, society or Section 8 company now applies for registration as a non-profit organisation under section 332 (the old 12A/12AB) so that its charitable income is exempt, and for approval under section 354 so that its donors can claim the deduction under section 133 (the old 80G). Both are applied for in one common form — Form No. 104 for provisional registration where activities have not yet commenced (the old Form 10A), or Form No. 105 for regular registration and renewal (the old Form 10AB) — on the income-tax e-filing portal. A separate CSR-1 filing with the MCA is needed to receive CSR funding from companies.

Understand It

What Is NPO Registration (12A), 80G Approval & CSR-1?

A quick, plain-language explanation before the details.

In simple terms

Registration as a non-profit organisation (the old 12A/12AB) makes an NGO’s charitable income exempt from income tax, 80G approval lets its donors claim a deduction on donations, and CSR-1 lets it receive CSR funding from companies.

Legally

Under the Income-tax Act, 2025, a trust, society or Section 8 company applies for registration under section 332 to become a “registered non-profit organisation” and claim the benefits of Part B of Chapter XVII (sections 332 to 355), and for approval under section 354 so that donations to it qualify for the donor’s deduction under section 133(1)(b)(ii). Rule 181 of the Income-tax Rules, 2026 prescribes one common application — Form No. 104 (provisional) or Form No. 105 (regular / renewal). These replace sections 12A/12AB and 80G of the 1961 Act and Forms 10A / 10AB.

Governing authority

Form No. 104 goes to the Commissioner of Income-tax (CPC), who issues the order in Form No. 106. Form No. 105 goes to the Principal Commissioner or Commissioner having jurisdiction over the applicant, who passes the order in Form No. 107. CSR-1 is filed separately with the Ministry of Corporate Affairs (MCA) to receive CSR funds.

Validity

Registration generally follows a provisional-then-regular route and is granted for a fixed period, after which it must be renewed by applying again in Form No. 105 within the window the Act allows.

Why it matters

Why Are NPO Registration, 80G Approval & CSR-1 Important?

For a charitable organisation these registrations unlock tax exemption, donor incentives and access to corporate CSR funding. Here is why each matters.

Talk to an NGO Compliance Expert →
  1. Income-Tax Exemption (Section 332)

A registered non-profit organisation gets the exemption regime of sections 332 to 355 — without registration the surplus is taxable like any other entity’s.

  2. Deduction for Donors (Section 133)

Approval under section 354 lets your donors claim a deduction on their donations — a strong incentive that helps you raise more funds.

  3. Access CSR Funding (CSR-1)

CSR-1 registration with the MCA is a prerequisite for receiving CSR contributions from companies obligated to spend on CSR.

  4. Donor & Grant Credibility

Income-tax registration, 80G approval and CSR-1 signal a compliant, recognised NGO — often required by corporate donors, grant-makers and foundations.

  5. Eligibility for Grants & Schemes

Many government schemes, CSR programmes and institutional grants ask for valid income-tax registration and 80G approval as a basic eligibility condition.

  6. Stay Compliant

Registration and timely renewal keep your exemption valid and protect the organisation from losing its tax-exempt status.

What Documents Are Required for NPO Registration, 80G Approval & CSR-1?

Requirements depend on your NGO’s constitution (trust, society or Section 8 company) and whether you are filing a provisional (Form No. 104) or regular (Form No. 105) application. Keep clear scans (PDF/JPG) ready — everything is collected securely online.

Important before you file

Form 104 vs Form 105

Form No. 104 (the old Form 10A) is only for provisional registration or approval where activities have not commenced. If activities have started, or you are converting or renewing, the form is Form No. 105 (the old Form 10AB). We confirm the correct form and section code before filing.

Apply within the window

Registration is granted for a fixed period, and the Act sets the window for each case. A late Form No. 105 is an “application with delay” that needs condonation — so we track the date for you.

CSR-1 is separate

CSR-1 is filed with the MCA, not the income-tax portal. Income-tax registration and 80G approval are generally needed before CSR-1 to receive CSR funding.

Correct constitution proof

The right constitution document — trust deed, society MOA or Section 8 COI/MOA/AOA — must be uploaded exactly as registered. A rejection caused by terms in the trust deed can be re-applied for once the deed is modified.

Common Mistakes That Delay Your Application

Filing Form No. 104 after activities have commenced — the rules treat it as non-est
Still quoting sections 12A / 80G and Forms 10A / 10AB in an application made under the new Act
Missing the renewal window and letting registration lapse
Objects in the trust deed / MOA not clearly charitable, or the trust not irrevocable
Uploading an outdated or unregistered constitution document
No PAN in the name of the organisation
Assuming CSR-1 is automatic — it is a separate MCA filing
Not maintaining books of account and donation records

TaxClue reviews your documents before filing to reduce avoidable errors.

Frequently Asked Questions

What is 12A and 80G registration called under the new Income-tax Act?
Under the Income-tax Act, 2025, which applies from 1 April 2026, 12A/12AB registration is registration as a non-profit organisation under section 332, and 80G approval is approval under section 354 for the purposes of the donor’s deduction under section 133. A registered entity is called a “registered non-profit organisation”. People still say “12A and 80G”, but applications now quote the new sections.
What is the difference between NPO registration (12A) and 80G approval?
Registration under section 332 (the old 12A/12AB) exempts a charitable trust, society or Section 8 company’s own income from income tax. Approval under section 354 (the old 80G) is for the benefit of donors — it lets people and businesses who donate to the NGO claim a deduction under section 133. Most NGOs apply for both together.
Which forms have replaced Form 10A and Form 10AB?
Rule 181 of the Income-tax Rules, 2026 prescribes Form No. 104 in place of Form 10A (provisional registration or approval where activities have not commenced) and Form No. 105 in place of Form 10AB (regular registration, conversion and renewal). The orders, earlier in Form 10AC and 10AD, are now passed in Form No. 106 and Form No. 107.
Who can apply for registration as a non-profit organisation?
Charitable and religious trusts, societies registered under the Societies Registration Act, and Section 8 (not-for-profit) companies constituted for charitable purposes can apply, among other categories listed in section 332. The organisation must have a PAN and a valid constitution document (trust deed, society MOA or Section 8 COI/MOA/AOA).
What is provisional versus regular registration?
A newly formed NGO whose activities have not commenced first obtains provisional registration on Form No. 104, issued by the Commissioner of Income-tax (CPC). Once activities commence it applies for regular registration on Form No. 105 to the jurisdictional Principal Commissioner or Commissioner. Regular registration is granted for a fixed period after which it must be renewed.
My NGO already has 12AB and 80G registration under the old Act. What should I do now?
Keep the existing orders and URN safe and note their validity dates — renewal now goes through Form No. 105 under the Income-tax Act, 2025. Matters relating to tax years up to 2025-26 continue to be governed by the 1961 Act. We review your orders and tell you exactly when and in which section code to apply.
Does NPO registration / 80G approval need to be renewed?
Yes. Registration and approval are granted for a fixed period and must be renewed by applying in Form No. 105 within the window the Act allows. A late application is treated as an application with delay and needs condonation, so we track renewal timelines for you.
What is CSR-1 registration and who needs it?
CSR-1 is a form filed with the Ministry of Corporate Affairs (MCA) that an NGO must obtain to be eligible to receive CSR (Corporate Social Responsibility) contributions from companies. Income-tax registration and 80G approval are generally required before an NGO can register through CSR-1.
What documents are required for NPO registration and 80G approval?
Typically the constitution document (trust deed, society registration certificate + MOA, or Section 8 COI + MOA/AOA), the PAN of the organisation, details of trustees/members/directors, a note on charitable activities, and financial statements of past years where available. Requirements vary slightly for provisional versus regular registration.
Can a new NGO with no past activity get registered?
Yes. A newly established trust, society or Section 8 company that has not yet started activities can apply for provisional registration and approval on Form No. 104, and later apply for regular registration on Form No. 105 once activities have commenced. If activities have already commenced, Form No. 104 cannot be used.
What are Form No. 113 and Form No. 114?
Form No. 113 (the old Form 10BD) is the statement of donations that an approved NGO must file for each financial year, on or before 31 May following that year. Based on it, the NGO issues a Form No. 114 certificate (the old Form 10BE) to each donor by the same date, which donors use to claim their deduction. Accurate donation records are essential.
Does the donation deduction cover the full donation amount?
Section 133 allows donors a deduction on eligible donations, but the extent of the deduction depends on the category of the institution and the limits set out in the section. Donors should refer to the specific conditions applicable to their donation.
Can a rejected application be filed again?
In limited cases, yes. Under rule 181, where Form No. 105 was rejected because documents were not furnished, a hearing was not availed, or because of terms in the trust deed that have since been modified, the NGO may re-apply once in Form No. 105 within one month from the end of the month in which the order was passed, with an undertaking that no appeal is pending or will be filed. An application can also be withdrawn within seven days of filing.
Is a Section 8 company eligible for NPO registration, 80G approval and CSR-1?
Yes. A Section 8 company incorporated for not-for-profit / charitable objects can apply for registration under section 332 and approval under section 354 on the income-tax portal, and for CSR-1 with the MCA, just like a trust or society, subject to meeting the applicable conditions.
Can TaxClue handle NPO registration, 80G approval and CSR-1 together?
Yes. Our CA team maps which registrations your NGO needs, prepares and files Form No. 104 / 105 on the income-tax portal, files CSR-1 with the MCA, handles departmental queries, and guides you on donation reporting and renewals — end to end.
What is the order of NPO registration, 80G approval and CSR-1?
Registration under section 332 (which exempts the NGO’s own income) and approval under section 354 (which lets donors claim a deduction) are applied for together in one form, and CSR-1 is filed with the MCA once they are in place. CSR-1 makes the NGO eligible to receive Corporate Social Responsibility contributions from companies.
Do I need NGO Darpan before applying for NPO registration, 80G approval and CSR-1?
An NGO-DARPAN Unique ID from NITI Aayog is separate from the income-tax and MCA registrations, but it is commonly required in practice — particularly for CSR-1 and for accessing government grants. Many NGOs obtain the DARPAN Unique ID alongside their income-tax registration, 80G approval and CSR-1.
Can a Section 8 company receive CSR funds?
Yes. A Section 8 company incorporated for charitable objects can obtain income-tax registration and 80G approval on the income-tax portal and file CSR-1 with the MCA, just like a trust or society. Once CSR-1 is registered and the other conditions are met, it is eligible to receive CSR contributions from companies.
