Legally

What is IBM registration?

Who must register with IBM under Rule 45?
The holder of a mining lease, and any person or company engaged in trading, storage, end-use or export of minerals mined in India. Form K also covers reconnaissance and prospecting activities, so licence holders register too.
When must I apply for IBM registration?
Rule 45(2) requires the application in electronic form within one month from the date of registration of the lease deed, or before commencement of trading, storage, end-use or export of minerals, as the case may be.
Which form is used for IBM registration?
The application is made in Form K of the MCDR Schedule. It must be digitally signed by the signing authority and is processed through the IBM Regional Office for the State where the activity is carried on.
Does IBM registration apply to minor minerals and coal?
No. Rule 2 of MCDR 2017 excludes petroleum and natural gas; coal, lignite and sand for stowing; and minor minerals. A State Government may extend some provisions to minor minerals, in which case the State’s own authority administers them.
Is there a government fee for IBM registration?
Rule 45 does not prescribe a registration fee. If IBM levies any charge in future, it will be at actuals. Our professional fee is quoted separately after a quick scope check.
What returns must a mineral trader or end-user file?
A person or company engaged in trading, storage, end-use or export of minerals files a monthly return in Form L before the tenth day of every month for the preceding month, and an annual return in Form M before 1 July for the preceding financial year, online to IBM and the concerned State Government.
What returns must a mining lease holder file?
A lease holder files online returns for each mine — a daily return through IBM’s application, a monthly return before the tenth of every month and an annual return before 1 July, in the F-series and G-series forms that apply to the mineral.
What happens if returns are not filed or are wrong?
Under Rule 45(7), for traders, stockists and end-users the State Government can suspend trading licences, transport permits, storage licences and end-use permits; for exporters, DGFT can suspend export permits; for lease holders, mining operations can be suspended. A notice and show-cause stage comes first.
Do I need a separate registration for each storage yard or plant?
No. One registration covers your activities, but every storage facility, plant or mine must be listed in Form K. Returns can be filed only for the locations included in the registration, so new locations must be added.
Is IBM registration valid for a fixed period?
Rule 45 does not set an expiry date. The registration continues while you carry on the activity, provided particulars are kept up to date and returns are filed on time.
Do mineral exporters need anything else?
Yes. Exporters need an IEC from DGFT and must follow the export policy for the mineral concerned. Many also take an RCMC from the relevant export promotion council. The IEC number is entered in Form K.
What is a Section 23C State licence in Form K?
Section 23C of the MMDR Act empowers States to make rules against illegal mining, transport and storage of minerals, and many States issue trading or storage licences under them. Where you hold such a State licence, its details are entered in Form K.
Can a proprietor register with IBM?
Yes. Form K has categories for an individual, an association of individuals, a firm and a company. The details required — PAN, address, partners or directors — depend on the category chosen.
How do I update my IBM registration?
