What Is CWC Registration & Declarations (NACWC)?

In simple terms

India has signed the Chemical Weapons Convention, which bans chemical weapons and tracks chemicals that could be misused to make them. Businesses that make, use or trade those chemicals register with India’s National Authority and report their activities every year, so India can report to the international body that verifies the Convention.

Legally

The Chemical Weapons Convention Act, 2000 gives effect to the Convention in India. Section 18 requires registration, subject to prescribed exemptions and thresholds, of persons engaged in activities involving toxic chemicals or precursors in Schedules 1 to 3, or in producing Discrete Organic Chemicals; Section 18(6) requires registered persons to furnish prescribed information, declarations and returns; and Section 12 empowers the National Authority to call for information. Section 15 restricts Schedule 1 activities, Section 16 restricts Schedule 2 transfers, and Section 17 requires imports and exports to follow the Export and Import Policy.

Governing authority

Administered by the National Authority Chemical Weapons Convention (NACWC), set up as an office of the Cabinet Secretariat, Government of India, which is India’s focal point with the Organisation for the Prohibition of Chemical Weapons (OPCW). Declarations are filed on NACWC’s online e-filing system.

Validity

Under Section 18(5), a certificate of registration is valid for the period specified in it and is renewable on payment of the prescribed fee. Declarations are recurring — past activities every year and anticipated activities before the year begins.

CAS numbers are key

Schedule families and DOC / PSF status are identified by chemical identity and CAS number. Trade names alone are not enough to decide whether a chemical is declarable.

Thresholds differ by schedule

Per NACWC, Schedule 2 plant sites declare above 1 kg (2A*), 100 kg (2A) or 1 tonne (2B); Schedule 3 above 30 tonnes; DOC plant sites above 200 tonnes, or 30 tonnes of a PSF chemical in a plant.

Calendar-year data

Declarations use calendar-year quantities, not the financial year. Opening and closing figures must reconcile across forms.

Traders declare too

Importers and exporters of Schedule 2 and Schedule 3 chemicals who do not produce them still declare their transfers through the trader forms.

Who is the authority in India?
The National Authority Chemical Weapons Convention (NACWC), set up as an office of the Cabinet Secretariat, Government of India. It fulfils India’s obligations under the Convention and is the national focal point with the OPCW.
What are Schedule 1, 2 and 3 chemicals?
Schedule 1 covers chemical-weapon agents and their close precursors; Schedule 2 covers key precursors; Schedule 3 covers dual-use chemicals produced in large quantities for legitimate purposes. The lists are in the Convention’s Annex on Chemicals and are available from NACWC and the OPCW.
What are DOC and PSF chemicals?
A Discrete Organic Chemical (DOC) is any compound of carbon (except its oxides, sulphides and metal carbonates) identifiable by name, structure or CAS number. A PSF chemical is an unscheduled DOC containing phosphorus, sulphur or fluorine. Hydrocarbons, explosives and most polymers are exempt from DOC declaration.
What are the declaration thresholds?
According to NACWC, Schedule 2 plant sites declare above 1 kg of a 2A* chemical, 100 kg of other 2A chemicals or 1 tonne of a 2B chemical; Schedule 3 plant sites above 30 tonnes; and DOC plant sites that synthesised more than 200 tonnes of DOC, or more than 30 tonnes of a PSF chemical in a plant, in the previous calendar year.
When are annual declarations due?
NACWC’s declaration guidelines ask declaring units to file their annual forms on or by 31 January each year. India then files national declarations with the OPCW — past activities within 90 days after the year ends and anticipated activities before the next year begins. Additionally planned activities must be declared before they start.
Where are declarations filed?
On NACWC’s online e-filing system for CWC declarations, developed by the Cabinet Secretariat for the Indian chemical industry. TaxClue prepares the forms and files them for you.
Do importers and exporters who do not manufacture also declare?
Yes. Importers and exporters of Schedule 2 and Schedule 3 chemicals declare their transfers through the relevant trader forms, with country-wise import and export details, even if they do not produce the chemicals.
Can Schedule 1 chemicals be imported or exported?
According to NACWC, export of Schedule 1 chemicals is prohibited, and import needs prior permission from the National Authority under Section 15 of the CWC Act, only for permitted research, medical, pharmaceutical or protective purposes.
What permissions are needed to export Schedule 2 and 3 chemicals?
Schedule 2 exports to State Parties need permission from DGFT, and trade with non-State Parties is prohibited. Schedule 3 exports to non-State Parties need an export licence and end-use / end-user certification, with intimations as NACWC and DGFT require.
What is the penalty for not registering or declaring?
Failure to register is punishable under Section 39, and failure to furnish information, declarations or returns under Section 46 of the Chemical Weapons Convention Act, 2000. Offences relating to Schedule 1 and 2 chemicals and illegal export or import carry heavier penalties.
Will my plant be inspected?
Not every declared facility is inspected. Plant sites above verification thresholds may be shortlisted for inspection by the OPCW, and NACWC coordinates such inspections. Accurate records and declarations make an inspection far smoother.
Is there a government fee for CWC registration?
The Act allows a fee to be prescribed for registration and renewal. Any government fee is billed at actuals. Our professional fee is quoted separately after the chemical screening and scope check.
Is CWC registration the same as pollution or hazardous-chemical approvals?
No. CWC registration is a disarmament and trade-control requirement. Your plant still needs pollution-control consents, factory licences, hazardous chemical rules compliance and other approvals separately.
Is the declaration based on the financial year?
No. CWC declarations use calendar-year quantities. Companies that keep financial-year records need to recompute production, consumption and trade figures for January to December.
