Who is a "Consumer"?

A consumer is a person who buys goods or hires/avails services for personal use and not for commercial resale. Even online purchases and digital services are covered. Key point: if goods are bought for resale or commercial purpose, the buyer is NOT a consumer under CPA 2019.

Product Liability — New in CPA 2019

Product liability holds manufacturers, sellers, and service providers responsible for harm caused by defective products or deficient services. Strict liability applies in many cases — the consumer need not prove negligence, only the defect and injury. Liability extends to:

  • Manufacturer: If product has manufacturing defect, design defect, or improper instructions
  • Product service provider: If inadequate safety warnings
  • Product seller: If seller had knowledge of defect and still sold it

E-Commerce Consumer Rights

CPA 2019 and the E-Commerce Rules 2020 require:

  • Platforms must display seller information, product details, and country of origin
  • Price, delivery date, and return/refund policy must be clearly shown
  • Grievance redressal officer mandatory for e-commerce platforms
