Who is a Consumer?

A consumer is a person who:

  • Buys goods for consideration (not for resale or commercial purpose)
  • Hires or avails of services for consideration (not for commercial purpose)
  • Beneficiary of goods/services (user, not necessarily the buyer)

Commercial purchases (for resale or commercial purpose) are excluded. However, purchases of goods/services for livelihood/self-employment are included.

Filing a Consumer Complaint

  1. Legal Notice: Send written notice to company (though not mandatory, advisable)
  2. Identify forum: Based on amount of compensation/goods/services value
  3. File complaint: Online (eDAKHIL portal: edaakhil.nic.in) or physically
  4. Documents: Invoice, correspondence, photos, contracts, and any evidence
  5. Fees: Nominal filing fee based on claim amount (Rs.200 to Rs.5,000)
  6. Time limit: 2 years from date of cause of action (extendable for sufficient cause)

E-Commerce Consumer Protection Rules 2020

Special rules governing e-commerce platforms:

  • E-commerce entities must display complete seller information (name, address, contact, registration details)
  • Authentic reviews only; no paid/fake reviews
  • Return and refund policy must be clearly stated
  • Price breakdown must be displayed
  • No mis-sell — goods must match description
  • Grievance Officer must be appointed with contact details on platform
  • Complaints resolved within prescribed timelines

Product Liability

Introduced for the first time in Indian consumer law:

  • Manufacturer's liability: For manufacturing defect; failure to warn of known risks
  • Service provider liability: For service deficiency
  • Seller's liability: For providing insufficient safety information; knowingly selling defective product
  • Liability exists even without proof of negligence (strict liability for consumer courts)

CCPA: Central Consumer Protection Authority

CCPA established with powers to:

  • Investigate unfair trade practices on its own initiative
  • Issue recall notices for unsafe goods
  • Impose penalties on misleading advertisements (fine up to Rs.10 lakh; Rs.50 lakh for subsequent offence)

  • Endorsers (celebrities, influencers): Liability for endorsing misleading ads; fine up to Rs.10 lakh; prohibited from endorsing for up to 3 years
  • ASCI (Advertising Standards Council of India) code also applicable
eDaakhil Portal: The Government has launched the eDaakhil portal for online consumer complaint filing. Complaints can be filed 24x7 from anywhere in India. The portal provides case tracking, hearing dates, orders, and electronic communication with the consumer commission. This has significantly improved access to consumer justice.
