Without a written Partnership Deed, profit-sharing and terms fall back to the Act, and Section 40(b) partner-pay clarity is lost. A CA-drafted deed avoids disputes.
Correct stamp duty
The deed must be executed on stamp paper of the correct state value. An under-stamped deed may be inadmissible as evidence and attract a penalty on the deficient duty.
