Understand It

What Is Income Tax Return Filing?

A quick, plain-language explanation before the details.

In simple terms

An Income Tax Return is the annual statement you file declaring your income, deductions and taxes paid for a financial year, so you pay the correct tax or claim a refund of excess TDS.

Legally

ITR filing is the return filed under the Income-tax Act, 1961 with the Income-tax Department. The correct form (ITR-1 to ITR-7) depends on the taxpayer’s income sources and status, and the return must be verified to be treated as valid.

Governing authority

Administered by the Income Tax Department via the e-filing portal (eportal.incometax.gov.in), where returns are filed and e-verified.

Validity

A return is valid only after e-verification within 30 days of filing. If not verified in time it is treated as invalid, as though it was never filed.

  2. 02

    Maximise Refunds

All deductions under 80C, 80D, 80G, HRA and LTA claimed accurately so you recover excess TDS.

Checklist

What Documents Are Required to File Your ITR?

Requirements are grouped by income/TDS, deductions and capital gains. Keep clear scans (PDF/JPG) ready — everything is collected securely online, and we provide a checklist matched to your ITR form.

Choose a document group

Income & TDS

Proof of income and tax paid
5 documents
  • Form 16 / 16A (salary & TDS certificates)
  • Form 26AS (tax credit statement)
  • AIS / TIS (Annual Information Statement)
  • Bank account statements for the financial year
  • Interest certificates (savings, FD, bonds)

Reconcile 26AS and AIS

Form 26AS shows TDS/TCS and taxes paid; the AIS/TIS reports interest, dividends, securities and property. Reconciling before filing prevents mismatches that trigger notices.

PAN must be Aadhaar-linked

An unlinked PAN becomes inoperative, causing TDS at a higher rate and processing issues. Ensure PAN–Aadhaar linking is done before filing.

E-verify within 30 days

After filing you must e-verify the return within 30 days via Aadhaar OTP, net banking or EVC, or by sending a signed ITR-V, or it is treated as invalid.

Form depends on your income

The correct ITR form varies with your income sources and status. We select it for you to avoid the notices that follow a wrong-form filing.

Frequently Asked Questions

Which ITR form should I file for AY 2026–27?
ITR-1 (Sahaj): resident with total income up to ₹50 lakh from salary, one house property and other sources. ITR-2: capital gains, more than one house or foreign income (no business). ITR-3: business or profession. ITR-4 (Sugam): presumptive income under 44AD/44ADA/44AE. TaxClue selects the correct form for your income.
What is the last date to file ITR for AY 2026–27?
31 July 2026 for individuals and others not subject to audit, 31 October 2026 for taxpayers requiring a tax audit, and 30 November 2026 for transfer-pricing cases. A belated or revised return can be filed up to 31 December 2026, with an updated return (ITR-U) allowed later.
Do I need to e-verify my ITR, and by when?
Yes. After filing you must e-verify the return within 30 days — via Aadhaar OTP, net banking, bank/demat EVC or by sending a signed ITR-V. If you do not verify in time the return is treated as invalid, as though it was never filed.
Should I choose the old or the new tax regime?
For FY 2025–26 the new regime is the default, and a resident individual with taxable income up to ₹12 lakh pays nil tax through the enhanced Section 87A rebate. The old regime can be better if you have large 80C/80D/HRA/home-loan deductions. To opt out of the new regime where you have business income you file Form 10-IEA. TaxClue computes both and files the lower-tax option.
Why must I reconcile Form 26AS and AIS before filing?
Form 26AS shows TDS/TCS and taxes paid, while the AIS/TIS reports interest, dividends, securities, property and other transactions reported to the department. Reconciling your return with them before filing prevents mismatches that trigger notices and processing delays.
What documents are needed to file ITR?
Typically Form 16/16A, Form 26AS, AIS/TIS, bank statements, investment and deduction proofs (80C, 80D and others), capital gains statements, rent receipts and home-loan interest certificate. TaxClue provides a checklist matched to your ITR form.
Can NRIs file their ITR through TaxClue?
Yes. TaxClue files NRI returns (usually ITR-2 or ITR-3) covering Indian-sourced income, DTAA relief, foreign income and asset reporting where applicable, and TDS refund claims on NRO income and property transactions.
What penalty applies if I miss the ITR due date?
A late-filing fee under Section 234F of ₹5,000 applies (₹1,000 if total income is up to ₹5 lakh), plus interest under Section 234A on any unpaid tax. You can still file a belated return up to 31 December 2026, but you lose the option to carry forward certain losses.
How is capital gains tax on equity treated now?
The annual LTCG exemption on listed equity and equity mutual funds is ₹1.25 lakh, with LTCG above that taxed at 12.5% (for transfers on or after 23 July 2024). STCG on equity is taxed at 20%. TaxClue computes gains correctly with the applicable rates and exemptions.
What is an Updated Return (ITR-U)?
An updated return lets you file or correct a return for an earlier period, subject to conditions, with additional tax of 25%–50%. It is useful if you missed reporting income or did not file for a past year.
Do I have to file ITR if my income is below the exemption limit?
Filing may still be required in certain cases — for example to claim a TDS refund, carry forward losses, or where you meet specified conditions such as high-value transactions or foreign assets. TaxClue advises whether you should file.
How can I claim a refund of excess TDS?
Excess TDS is refunded only by filing your ITR. We reconcile the TDS in Form 26AS, compute your actual liability and claim the refund, which is credited to your pre-validated bank account after processing.
How do I file my income tax return online step by step?
Log in to the income-tax e-filing portal (incometax.gov.in) with your PAN, go to e-File → Income Tax Return, select the assessment year and the correct ITR form, choose the old or new regime, verify the pre-filled salary, TDS, interest and capital-gains data against Form 26AS and the AIS, pay any balance tax, submit, and e-verify within 30 days. TaxClue does all of this for you and shares the acknowledgement (ITR-V).
Can I file my ITR without Form 16?
Yes. Form 16 is only a convenience — you can file using your salary slips, Form 26AS and the AIS/TIS, which already show your salary, TDS and other income reported to the department. TaxClue reconstructs your income from these sources and files an accurate return even if your employer has not issued Form 16.
What is the difference between ITR-1 and ITR-2?
ITR-1 (Sahaj) is for a resident individual with total income up to ₹50 lakh from salary, one house property and other sources such as interest. ITR-2 is for those with capital gains, more than one house property, foreign income or assets, or total income above ₹50 lakh — but no income from business or profession. If you run a business or profession you file ITR-3 or ITR-4 instead.
How long does an income tax refund take after filing?
Most refunds are credited within 7 to 30 days of e-verification, once the return is processed under Section 143(1). The refund is paid only to a pre-validated bank account linked to your PAN. Delays usually happen when the bank account is not pre-validated, PAN is not linked to Aadhaar, or the return is picked up for detailed processing.
Is it mandatory to file ITR if TDS has already been deducted?
Yes — if your total income exceeds the basic exemption limit, filing is mandatory even when full TDS has been deducted, and filing is the only way to claim a refund of any excess TDS. You may also have to file despite income below the limit in specified cases, such as high-value deposits, foreign assets, or large electricity or foreign-travel spends.
How can I check my ITR filing and refund status?
Log in to the e-filing portal and open e-File → Income Tax Returns → View Filed Returns to see whether your return is submitted, verified or processed. Refund status is shown there and can also be tracked on the NSDL/TIN refund-status page using your PAN and the assessment year.
