Geographical Indications (GIs) of Goods are governed by the Geographical Indications of Goods (Registration and Protection) Act 1999 (GI Act) and GI of Goods (Regulation and Prevention of Improper Use) Rules 2002. The GI Registry is at CGPDTM Chennai.
Legal Definition and TRIPS Compliance
Article 22 of TRIPS Agreement defines GI as: "indications which identify a good as originating in the territory of a member, or a region or locality in that territory, where a given quality, reputation or other characteristic of the good is essentially attributable to its geographical origin."
India's GI Act 1999 implements TRIPS GI obligations and provides stronger protection for wines and spirits (Article 23 TRIPS) through additional anti-dilution provisions.

GI Registration Process
- Applicant (producers association/government body) files Form GI-1 with GI Registry, Chennai
- Application must contain: name of goods, geographical area, quality/reputation/characteristics, historical evidence of origin, proof of existing use, production details
- Examination by Examiner — within 1 month issues examination report
- If deficiency: applicant responds within 2 months
- Application advertised in GI Journal (CGPDTM publication) — open for 3 months opposition
- If no opposition (or opposition decided): GI registered; certificate issued
- Validity: 10 years from date of application; perpetually renewable
Authorized User Registration
- Individual producers of the GI product must register as Authorized Users (Form GI-1A)
- Only authorized users can use the GI tag on their products
- Authorized user registration: 10 years; renewable
- Unauthorized use of registered GI = infringement
Enforcement and Remedies
- Civil remedy: Injunction, damages, account of profits, delivery of infringing goods
- Criminal remedy (Section 38): imprisonment up to 3 years + fine Rs.50,000–2 lakh for false GI use
- Customs enforcement: Customs can seize imported goods bearing false/unauthorized GI
