Code on Social Security section 1(4) notification now covers the whole area of 31 Gujarat districts from 1 October 2026: ESIC circular on S.O. 5310(E)

ESIC has circulated Gazette notification S.O. 5310(E) dated 25 September 2026 of the Ministry of Labour & Employment, issued under section 1(4) of the Code on Social Security. It applies to the entire areas of 15 districts of Gujarat that were non-implemented and 16 that were partially implemented, with effect from 1 October 2026.

By a circular dated 6 October 2026 (No. N-15013/1/2021-P&D), the Employees’ State Insurance Corporation has circulated, for information, a copy of notification S.O. 5310(E) dated 25 September 2026. The notification was published by the Ministry of Labour & Employment in the Gazette of India (Extraordinary), Part II, Section 3, Sub-section (ii) on 25 September 2026. The circular gives the Gazette ID as CG-DL-E-26092026-276530.

The subject of the circular is the notification under section 1(4) of the Code on Social Security in the entire areas of 31 districts of Gujarat. It takes effect from 1 October 2026.

Who the circular is addressed to

The circular is marked to the Regional Director, Gujarat, for information and necessary action, and to the website content management wing at Headquarters for uploading. It is signed by the Deputy Director, Planning and Development, ESIC Headquarters.

What the circular does not say

The circular is a forwarding note for the Gazette notification. It does not set out registration steps, timelines or any transitional arrangement for employers in the newly covered areas, and it does not reproduce the text of the notification. For those points, the notification S.O. 5310(E) itself has to be read.

What employers in Gujarat should do

If your establishment is in one of the 15 districts that were earlier non-implemented, or in a part of the 16 districts that was earlier outside the implemented area, note that the section 1(4) notification applies to the entire district from 1 October 2026. Check your position against the notification and with the ESIC Regional Office, Gujarat.
