Bankers’ Books Evidence Act, 2026 in force from 1 October 2026; replaces the 1891 law

The new Act recognises bank records kept in electronic, digital and cloud-based form, standardises their certification, and requires a “special cause” in writing to summon bank officials.

What the Act does

The Bankers’ Books Evidence Act, 2026 replaces the Bankers’ Books Evidence Act, 1891 and provides a modern framework for using banking records as evidence, in line with present banking practice.

The main features, as described by the Ministry of Finance

  • Technology-neutral records — banking records maintained in physical, electronic, digital, virtual, cloud-based and other contemporary forms are recognised.
  • Standard certification — simplified and standardised certification of banking records, including through manual, digital or electronic signatures.
  • Summoning bank officials — where the bank is not a party to the proceedings, a “special cause” is to be recorded in writing by the Court for such summoning.
  • Room to extend — the Central Government may extend the provisions to specified financial sector entities or classes of entities.

Why it matters in practice

Anyone who produces bank records in a legal proceeding, and every bank that certifies them, now works under the 2026 Act, which is in force from 1 October 2026. The release gives the features above; the form of the certificate is in the Act itself.
