NCLAT Principal Bench: mentioning, adjournment and extension-of-time requests only by e-mail in Forms A to D, by 3 PM the previous working day
By Circular No. 113/2026 dated 10 September 2026, NCLAT has prescribed forms for four kinds of requests before its Principal Bench, New Delhi. Under the accompanying SOP they are to be sent only by e-mail to principalbench.mentioning@nclat.gov.in by 3:00 PM on the preceding working day. Requests not in the prescribed format will not ordinarily be processed.

What the circular says
Circular No. 113/2026 dated 10 September 2026 (F.No. 10/37/2018-NCLAT), issued by order of the Officiating Chairperson, notifies that henceforth all applications for filing of any application in pending matters, urgent listing / mentioning of fresh appeals or applications, adjournment applications and applications for extension of time before the National Company Law Appellate Tribunal, Principal Bench at New Delhi, shall be submitted in the prescribed Forms as per the Standard Operating Procedure dated 10 September 2026. The circular supersedes or modifies earlier circulars and orders that are in contravention of it.

How and when to send
- All four requests are to be submitted only through e-mail at principalbench.mentioning@nclat.gov.in.
- The subject line must mention the case number / e-filing number, the nature of the request and the date of listing (where applicable).
- They must reach latest by 3:00 PM on the working day (Monday to Friday) preceding the date on which the request is intended to be considered. Later requests are ordinarily considered on the next working day unless the Bench directs otherwise.
Extra steps for an adjournment
Where notice has already been issued, a copy of the adjournment application is to be served on all appearing parties before it is sent to the Registry, and proof of service must accompany the form. The applicant shall, as far as practicable, obtain a “No Objection” endorsement from the opposite counsel. If it is refused, the application must say so in these words: “No Objection was sought from the opposite party, however the same was declined/refused.” The absence of the endorsement does not by itself stop the matter being placed before the Bench.
What happens next
The Registry checks that the prescribed format is used, all particulars and supporting documents are furnished and proof of service is enclosed where required. Complete applications are placed before the Bench having jurisdiction. After the Bench passes orders, the Registry communicates the decision to the e-mail address given in the application.
The SOP is explicit on three points: mere filing of an application does not entitle the applicant to urgent listing; no application is treated as allowed merely because it was sent by e-mail; and a false statement or suppression of material facts may invite appropriate orders. The Bench’s discretion to permit or refuse urgent listing, adjournment or extension of time, or to direct physical appearance, is untouched.
What counsel should do
Download Forms A to D from the NCLAT website, send the request from the e-mail address on which the order is to be received, and send it before 3:00 PM on the previous working day. For an adjournment, serve the other side first and attach the proof.
